Teachers "one after another" registered to start a tutoring business, some were confused, going back and forth without completing the procedures.

Some teachers said they had to wait a long time to submit their application to register for tutoring under Circular 29, and some of them had not completed the procedure even after the third time.

Registering a tutoring business: Looking for detailed instructions

Starting from February 14, Circular 29 of the Ministry of Education and Training regulating extra teaching and learning officially took effect. Accordingly, Article 6 of this Circular stipulates that organizations or individuals organizing extra teaching and learning activities outside of school with fees from students (collectively referred to as extra teaching establishments) must carry out business registration requirements according to the provisions of law. Therefore, in the past few days, many teachers have been present at the one-stop department in districts to complete registration procedures.

Talking to PV Dan Viet , teacher Luong Van Huy, a math teacher in Thanh Tri district, Hanoi said: "I registered to teach extra classes under the form of a sole proprietorship. Because we have all the required facilities and ensure fire prevention, the business registration procedures were very convenient."

A teacher in Hoang Mai district also said: "We have been teaching for many years, so we registered our business before Circular 29 and paid taxes in full. I think this regulation is reasonable and there are no problems during the implementation process."

However, not all teachers have a smooth process of registering for a tutoring business.

Dan Viet reporters were present at the one-stop department of Thanh Xuan district, Hanoi on February 19. Some teachers there said they still could not continue teaching extra classes because of some problems.

Ms. Nguyen Mai Anh, a freelance Chinese teacher in Thanh Xuan district, shared that she is currently having trouble with the conditions for registering as an individual business, so she has had to temporarily stop teaching at home.

According to Ms. Mai Anh, her family’s apartment has 3 bedrooms, so she has reserved a spacious room for extra classes for many years. When she heard about Circular 29, Ms. Nhung was worried and asked her friends what documents were needed and where to submit them.

On February 19, Ms. Mai Anh went to the one-stop office in Thanh Xuan district to register her business and was told that the condition was that a house on the ground could be used as a business location, and that an apartment building with residential purposes was not on the list.

"I don't know what to do with this condition because renting a house is quite expensive and I have to ensure fire safety. I am currently applying to a center near my house but will have to pay 20% of the tuition fee to them," Ms. Mai Anh said.

Sitting and waiting in a tired mood, holding many papers to register a sole proprietorship, a teacher in this district said: "This is the third time I have come to do the business registration procedures. This time I have corrected it according to the instructions of the officer receiving the documents, but I don't know if the documents are ready or if I have to go back like last time."

According to this teacher: "The previous times I came to apply, I printed the paper and filled out the information but it was returned because the content was incorrect. The second time was for the same reason. I wanted to ask for more detailed support but was told to look at the sample instructions on the website."

When asked why she didn't submit online, the teacher sighed: "I filled in the information and submitted many times but the system just kept spinning and couldn't submit. I don't understand why. I just wish the procedure was simpler and faster so that we teachers wouldn't have to spend so much time registering."

Similarly, another teacher also came here for the second time because he filled in incorrect information and hoped for more detailed instructions to make the registration process easier.

Many places have seen a sudden increase in the number of applications for tutoring business registration.

It is known that in the past few days, the one-stop-shop department in localities has received a sudden increase in the number of applications for tutoring business registration.

A representative of the one-stop shop in a district in Hanoi said that in recent days, the number of people coming to register for business registration procedures for tutoring has increased. Every day, the department receives and processes about 20 related documents. The principle of registering a business household is that it is not allowed to set up a location in an apartment building, a collective house, etc., so finding a place to teach tutoring will be more difficult than before.

In Hai Phong, Mr. Pham Dinh Phuc, Head of the Business Registration Office of the Department of Planning and Investment, said that in recent days, the number of households applying for business registration in the education sector has increased dramatically.

Specifically, in the first two months of 2025, the Business Registration Office received and processed more than 200 dossiers related to business registration in the education sector. Of which, 73 dossiers were newly established and 129 dossiers were changed in registration content and additional registrations related to the education sector, equal to the whole year of 2024.

It is known that in Nghe An, after the Ministry of Education and Training issued Circular 29, the number of people submitting applications to establish business households increased dramatically with 300 applications as of February 16.

Instructions for registration procedures for tutoring business

To register for extracurricular tutoring business, organizations and individuals must prepare documents according to the provisions of Article 87 of Decree 01/2021/ND-CP, which clearly states that the registration documents for individual business households include:

1. Application for business registration.

In which, the Industry Code is: 8559 Industry name: Other education not classified elsewhere

2. Legal documents of individuals for business owners, household members registering for business households in case household members register for business households (copy of CCCD/ID/Passport/Other legal personal identification documents that are still valid).

3. A copy of the minutes of the household members' meeting on the establishment of a business household in case the household members register for a business household;

4. A copy of the authorization document of a household member for a member to be the business owner in case the household members register the business.

5. Copy of the teaching location lease contract in case of renting a business location.

After having all valid documents, the application for business registration will be submitted. Based on Point b, Clause 1, Article 14 of Decree 01/2021/ND-CP, individual business registration applications can be submitted in two ways:

- Submit directly to the Department of Finance and Planning (District-level business registration office where the business household is headquartered)

- Submit online at http://hokinhdoanh.dkkd.gov.vn.

Upon receiving the application, the district-level Business Registration Office shall issue a Receipt and a Business Registration Certificate to the business household within 3 working days from the date of receipt of the valid application.

In case the dossier is invalid, within 3 working days from the date of receipt of the dossier, the district-level Business Registration Office must notify in writing the dossier submitter or the business household founder. The notice must clearly state the reasons and requirements for amendments and supplements to the dossier (if any).

If after 3 working days from the date of submission of the application for business household registration, the Business Household Registration Certificate is not received or the notice requesting amendments or supplements to the business household registration application is not received, the business household founder or business household has the right to make complaints and denunciations in accordance with the provisions of law on complaints and denunciations.
