Businesses increasingly interested in legal support
Regarding the long-term resilience of enterprises, legal issues and legal corridors are very important for enterprises to understand and be more confident in making decisions for production, business and investment activities. It is like knowing traffic laws, going out on the road, you will know how fast to go, how to go, where to turn left and right.
That was shared by Mr. Cao The Anh, Vice Chairman of Hanoi Young Entrepreneurs Association, General Director of ALO Media Joint Stock Company at the Conference on implementing Decision No. 345 of the Prime Minister on approving the Project "Improving the quality and effectiveness of legal support for enterprises in the period 2021 - 2030" organized by the Ministry of Justice on the morning of October 24.
Mr. The Anh said that currently, the demand for legal support, improving legal capacity and resolving disputes arising in the production and business activities of enterprises is increasing.
However, with 97% of Vietnamese enterprises currently being small and medium-sized enterprises, enterprises do not have enough resources to invest in human resources with knowledge, qualifications and skills related to legal issues.
“What businesses care about most is how to do it right. We hope that management agencies will improve the legal system and enforce the law. Businesses are most afraid of management agencies or law enforcement officers doing wrong; even more afraid is not doing anything because they are afraid of making mistakes. This makes administrative procedures or backlog issues difficult to implement.
There are different ways to understand a problem, and in the end, we have to wait or ask the government , ministries and agencies, which takes a long time to resolve. When the opportunity passes, the time businesses have to wait is a wasted capital cost and opportunity cost. In reality, many businesses cannot wait and have to withdraw from the market," Mr. The Anh stated the current situation.
Dr. Tran Minh Son, Head of the Office of the Inter-sectoral Legal Support Program for Enterprises for the period 2020 - 2025 (Ministry of Justice) said that the Project identifies 5 specific goals. That is to complete the legal framework on legal support for enterprises, strive to have 100% of legal regulations on enterprises, on the rights and obligations of enterprises be informed promptly and fully; ensure that 100% of enterprises receive legal support when there is a proposal.
The project aims to pilot and replicate at least two effective legal support models for businesses nationwide; apply digital transformation, and build an ecosystem on this issue in 63 provinces and centrally-run cities...
Need to increase legal consulting support for businesses
Lawyer Nguyen Duy Lam, Chairman of the Business Law Club, pointed out that it is necessary to continue perfecting the legal support system for businesses; and to have specific regulations on administrative procedures, taxes, customs, and credit access.
In particular, according to Mr. Lam, the legal consultancy support fee should also be regulated at a higher level. Because the current support fee is no more than 3 million VND/year for micro enterprises, 5 million VND/year for small enterprises and no more than 10 million VND/year for medium enterprises, which is too low.
Therefore, the lawyer recommended that the Ministry of Finance should review, balance, and allocate the budget for the legal support program for businesses, and coordinate with the Ministry of Justice to review and revise the spending level to a higher level, in accordance with the requirements of the activities.
Sharing the same view, Lawyer Le Hong Lam, Head of the Administrative Procedure Review Team of the Vietnam Bar Federation, said that this cost level does not encourage lawyers to join the network to support small and medium enterprises.
In addition, according to Lawyer Le Hong Lam, many businesses are also afraid because if they approach and receive support from the state, they risk having their business secrets revealed because they have to send the content of legal advice documents to state agencies to be made public in the mass media.
Besides, businesses are reluctant to carry out administrative procedures with state agencies to receive low support.
