Today, the National Assembly spent the whole day discussing the draft Law on Social Insurance (amended).

The draft Law was discussed and commented on by the National Assembly for the first time at the 6th Session (October 2023). Immediately after the session, the Standing Committee of the Social Affairs Committee chaired and coordinated with the drafting agency to urgently study and absorb the opinions of National Assembly deputies to revise the draft Law.

At the same time, organize expert seminars to give opinions on some major contents of the draft Law, organize working sessions with relevant agencies, send documents requesting the Government , agencies of the National Assembly, agencies under the National Assembly Standing Committee, relevant ministries and branches to give opinions on the content of acceptance and preliminary revision.

Recently, the draft Law continued to be discussed at the 31st Session of the National Assembly Standing Committee (March 15), then submitted to full-time National Assembly deputies for comments (March 31).

Within the framework of the 12th Plenary Session on May 3, the Social Committee organized to receive, explain and revise the draft Law on Social Insurance (amended) to submit at the 7th Session of the 15th National Assembly.

At the meeting, delegates spoke, discussed and contributed many opinions related to important contents of the draft Law such as: late payment of compulsory social insurance, evasion of compulsory social insurance payment and handling measures; special mechanism to protect employees in case the employer is no longer able to pay social insurance for employees; supplementary pension insurance; complaints and settlement of complaints against administrative decisions and administrative acts on social insurance of state administrative agencies...

There needs to be a solution for workers to continue participating in social insurance.

Discussing on the sidelines of the 7th session of the National Assembly about some contents in the draft Law, delegate Nguyen Hoang Bao Tran ( Binh Duong delegation) expressed his interest in the regulations on receiving one-time social insurance benefits and the regulations on late payment and evasion of social insurance payments. These are contents with many different opinions that many National Assembly delegates participated in contributing their comments.

Delegates believe that no matter which option is chosen, the important thing is that we must have a solution to keep workers in or quickly return to the labor market, continue to participate in social insurance, that is the fundamental and long-term solution.

Regarding one-time social insurance benefits, delegates said this is a rather sensitive and complicated issue, and this content has had a precedent in the past of encountering reactions from a segment of workers when there were proposed changes.

Delegates highly appreciated the efforts of the drafting committee and the agency in charge of reviewing and carefully assessing the impact in a multi-dimensional manner to propose two options that can be said to be optimal for the National Assembly to consider.

Option 1: Regulations on one-time social insurance benefits for two different groups of employees: Group 1: For employees who participated in social insurance before the Social Insurance Law (amended) took effect, after 12 months of not being subject to compulsory social insurance, not participating in voluntary social insurance and not having paid social insurance for 20 years, if requested, they will receive one-time social insurance. Group 2: For employees who started participating in social insurance from the date the Social Insurance Law (amended) took effect onwards, they will not receive one-time social insurance.

Option 2: The employee will be partially resolved but not more than 50% of the total time contributed to the pension and death fund. The remaining time of social insurance contribution is reserved for the employee to continue participating and enjoying social insurance regimes.

However, the delegate said that in the face of recent difficulties as well as the forecast that the world economy will continue to have many fluctuations in the near future, public opinion and workers' awareness is still not deep enough about the long-term benefits that social insurance brings when workers reach retirement age, so designing a reasonable roadmap will help workers and people understand the essential nature of social insurance policies, thereby gradually changing perceptions and creating high consensus with the decisions of the National Assembly.

“Each proposed option has its advantages and disadvantages. No matter which option is chosen, there must be a solution to keep workers in the labor market or quickly return to the labor market, continue to participate in social insurance, that is the fundamental and long-term solution,” the delegate of Binh Duong emphasized.
