Violently slash drinking buddy

At about 5:30 p.m. on November 23, 2024, Nguyen Van Trung (born in 1958) organized a drinking party at home with Sang, Giao, Nguyen Van Thanh (born in 1981, residing in the same hamlet) and Huynh Thanh Hong (born in 1985, residing in Long Binh town, An Phu district). An argument broke out, Sang took the beef pan from the tray and threw it away. The beef was bought by Giao, so the two had another conflict. Sang agreed to buy the beef back and return it to Giao.

It seemed that the small conflict would be resolved, but another incident occurred when Sang borrowed Giao's motorbike to buy food. The traffic police of An Phu district police drew up an administrative violation record and temporarily detained the vehicle when they discovered that Sang had an alcohol concentration of 0.816 mg/liter of breath (exceeding the regulation of 0.4 mg/liter of breath). Walking back to Trung's house, Sang immediately told Giao about the incident.

After hearing that, Giào's anger continued to rise. The subject cursed and rushed to hit Sang many times. Sang moved away, Giào took the hammer and slashed once. Sang quickly raised his hand to block, replying: "Let me do it slowly, I will redeem your bike". Giào still showed his aggressive, thuggish nature, continuing to rush to slash Sang's head. Being slashed, Sang begged: "You're bleeding a lot, Giào, let me redeem your bike tomorrow". Giào slashed Sang two more times.

Trung ran to stop him, so Giao threw away the hammer and went out into the street. Khanh An Commune Police arrived at the scene to stop and resolve the incident. At the same time, they made a record of the arrest of Giao, seized related evidence, and brought the subject to the headquarters for questioning. Sang was taken to An Phu District Medical Center for emergency treatment. On November 28, 2024, the victim was discharged from the hospital with a disability rate of 13%. After that, Giao was prosecuted and detained for investigation.

According to the Trial Panel, the defendant Giao was aware that using a hammer to hit someone's head was very dangerous and could lead to death. However, the defendant was too aggressive, acted decisively, and did not think about the consequences. More importantly, even though the victim pleaded sincerely, the defendant did not stop. That action showed that the defendant intentionally wanted to take the victim's life, but everyone stopped him and took him to the hospital in time, so he escaped death.

Through the above actions, it can be seen that the defendant's behavior is very dangerous to society, showing hooliganism, illegally infringing on the victim's health. At the same time, it seriously affects the social order in the locality, requiring a severe penalty to be enough of a deterrent. After considering the relevant circumstances of the case, at the end of the trial, the Provincial People's Court decided to sentence the defendant Giao to 8 years in prison for the crime of "Murder", according to Point n, Clause 1, Article 123, Penal Code.
