Prosecution and temporary detention of subjects producing and trading fake herbal products

The Investigation Police Agency, Provincial Police has just issued a Decision to prosecute a criminal case, a Decision to prosecute the accused and an Order to arrest the accused to temporarily detain Ms. Nguyen Thi Hoi, 42 years old, former Director of Tran Kim Huyen Company Limited (address Ea Mtă A hamlet, Ea Bhốk commune, Cu Kuin district) to investigate the acts of "Production and trading of counterfeit goods" and "Production and trading of counterfeit food" according to Articles 192 and 193 of the Penal Code 2025.

Previously, on January 7, 2025, the Police discovered that Tran Kim Huyen Company Limited, whose Director is Ms. Nguyen Thi Hoi, was storing 1,608 products, including: 577 Bone and Joint Herbal Extract products; 269 Stomach products; 40 Massage Oil products; 722 Mouthwash products, all bearing the Tran Kim Huyen brand, along with many raw materials, packaging, labels, and vouchers of all kinds without invoices or documents proving their origin.

The product Cao bach thao xuong khong of Tran Kim Huyen Company Limited is fake in origin and source.

Initial investigation results determined that Ms. Nguyen Thi Hoi had arbitrarily organized the production of Cao bach thao for bones, joints, stomach, massage oil, and herbal mouthwash at Tran Kim Huyen Company Limited, but on the product label and packaging, the name and address of the production organization was shown as the Center for Application of Science and Technology of Medicinal Materials, located at Km 12.9 Ngoc Hoi Street, Ngu Hiep Commune, Thanh Tri District, Hanoi City without the consent of the production unit named on the packaging.

It is worth mentioning that among the 1,608 detected products, 1,339 products had ingredient indicators that did not meet 1-4 indicators compared to the announcement on the packaging and product label, and 846 products of Cao bach thao xuong khoi va dat, which were registered and declared as health protection foods and were issued a Certificate of Acceptance of Product Declaration by the Department of Food Safety - Ministry of Health, were all fake foods in terms of quality and origin.

The case is currently being further investigated and clarified by the Provincial Police Investigation Agency.
