What documents are required to apply for permanent residence?

Regarding this issue, lawyer Dinh Van Tung - Ho Chi Minh City Bar Association responded as follows:

At Clause 1, 3, Article 6 of Circular No. 35/2014/TT-BCA dated September 9, 2014 of the Ministry of Public Security detailing the implementation of a number of articles of the Law on Residence and Decree No. 31/2014/ND-CP dated April 18, 2014 of the Government regulating permanent residence registration dossiers as follows:

- Notice of change of household registration and population;

- Population declaration (for cases where a population declaration is required);

- Household registration transfer certificate (for cases requiring household registration transfer certificate as prescribed in Clause 2, Article 28 of the Law on Residence);

- Papers and documents proving legal residence as prescribed in Article 6 of Decree No. 31/2014/ND-CP dated April 18, 2014 of the Government detailing a number of articles and measures to implement the Law on Residence.

In case of legal accommodation rented, borrowed, or shared accommodation, the lessor, lender, or shared accommodation must agree to register permanent residence at the accommodation and record it on the household registration and population change notification form, sign, and clearly state full name.

In case the lessor, lender, or host has given written consent to permanent residence registration at his/her residence, it is not necessary to record it on the household registration and population change notification form.

For legal accommodation rented, borrowed, or temporarily rented in a centrally-run city, there must be confirmation from the People's Committee at the commune level on the average area conditions guaranteed according to the regulations of the People's Council of the centrally-run city.

In case of family relationships such as paternal or maternal grandparents, father, mother, wife, husband, children and siblings, aunts, uncles, nieces and nephews moving in together; minors who no longer have parents or have parents but their parents are unable to raise them, disabled people who are unable to work, people with mental illness or other diseases that cause loss of cognitive ability or ability to control behavior moving in with a guardian do not have to present documents or papers proving legal residence but must present documents proving or confirming the above relationship from the People's Committee of the commune, ward or town.

Place to submit permanent residence application:

For centrally-run cities, submit application to district, county or town police.

For provinces, submit the application at the police station of the commune or town in the district, or the police station of the town or city in the province.

Procedures for permanent residence registration include:

- Prepare complete documents for each permanent residence registration subject.

- Submit application directly to the police station of the commune/ward where you have registered your permanent residence, or submit online via the online public service portal: National Public Service Portal, National Population Data Center Portal

- Supplement documents if any, pay registration fee

- Receive notification of settlement results according to appointment form.
