The draft detailed regulations on extra teaching and learning include: responsibilities of People's Committees at all levels and education management agencies in implementing regulations on extra teaching and learning; management and use of funds for organizing extra teaching and learning; inspection, examination and handling of violations in extra teaching and learning activities in the province.
This document applies to tutors and learners; organizations and individuals organizing tutoring and learning; and related organizations and individuals in Tay Ninh province.
Article 8 of the draft stipulates the responsibilities of tutoring establishments as follows:
Facilities providing additional teaching and learning activities must comply with the regulations on additional teaching and learning; cases where additional teaching and learning is not allowed; regulations on additional teaching and learning are specified in Articles 3, 4, and 6 of Circular No. 29/2024/TT-BGDDT and other relevant legal regulations.
Manage extra teaching and learning activities, ensure the quality of extra teaching and learning and the rights of students and tutors; manage and use extra teaching money according to regulations. Extra teaching facilities manage and keep records of extra teaching and learning according to regulations. Extra teaching facilities receive and process opinions, recommendations and wishes of students and parents about extra teaching and learning before and during the implementation process. Extra teaching facilities report and explain the implementation of this regulation and relevant legal regulations to competent authorities when requested. Extra teaching facilities are subject to inspection and examination by local authorities and education management agencies at all levels in the implementation of regulations on extra teaching and learning.
Article 9 of the draft stipulates the management of funds for extra teaching and learning in schools as follows:
Funding for organizing extra teaching and learning in schools uses the State budget and other legal funding sources according to the provisions of law.
Management and use of funding sources for extra teaching and learning shall comply with the provisions of law on finance, budget, accounting and other relevant regulations.
For extra-curricular teaching and learning outside of school, Article 10 of the draft stipulates that the funding for organizing extra-curricular teaching and learning is collected from the extra-curricular learners. The level of extra-curricular learning fees outside of school is agreed upon between the parents, the students and the extra-curricular teaching facility. The level of tuition fees and other fees (if any) must be publicly announced before organizing the class and cannot be changed in the middle of the semester without the consent of the parents. All fees must have receipts and valid documents.
The collection, management and use of tuition fees shall comply with the provisions of the law on finance, budget, assets, accounting, taxes and other relevant regulations.
According to Article 12 (on handling violations), educational institutions, tutoring facilities, organizations and individuals violating regulations on tutoring and learning, depending on the nature and severity of the violation, will be handled according to current regulations of law.
Heads of agencies, organizations and units whose cadres, civil servants and public employees violate regulations on extra teaching and learning, depending on the nature and severity of the violation, shall be handled according to regulations.
Heads of units are responsible for criticizing, reminding, and promptly disciplining cadres, civil servants, public employees, and workers under their management when there are violations of regulations on extra teaching and learning.
Regarding the responsibility for managing extra teaching and learning activities, in addition to specialized agencies and local authorities at all levels, Article 7 of the draft stipulates the responsibilities of heads of general education and continuing education institutions. Specifically, the head of the agency is responsible for organizing extra teaching and learning in schools according to the provisions of Article 5 of Circular No. 29/2024/TT-BGDDT and other relevant legal provisions.
The head of the educational institution shall review the students who need extra classes as prescribed in Clause 1, Article 5 of Circular No. 29/2024/TT-BGDDT at the end of the semester and the end of the school year. The head of the unit shall develop a plan for extra classes for students in accordance with the situation and characteristics of the unit, and report to competent authorities to arrange funds from the budget for organizing extra classes in the school.
The head of the unit mobilizes legal financial resources to support extra teaching and learning activities in schools, ensuring compliance with legal regulations.
Manage teachers who are teaching at school when participating in extra-curricular teaching outside of school to ensure compliance with regulations in Clause 3, Article 6 of Circular No. 29/2024/TT-BGDDT, coordinate to monitor and inspect extra-curricular teaching activities outside of school of teachers who are teaching at school.
Be responsible to the direct management agency for the organization of extra teaching and learning, the quality of extra teaching and learning in schools; the management and use of funds for organizing extra teaching and learning in schools according to regulations.
Handle according to authority or recommend competent authorities to handle violations of regulations on extra teaching and learning; receive and handle opinions, recommendations, and wishes of students and parents on extra teaching and learning before and during the implementation process. Periodically at the end of the semester and the end of the school year, summarize reports on the situation of extra teaching and learning as required by the education management agency.
The total estimated implementation cost for the 2029-2030 school year is over 189 billion VND, including: 2024-2025 school year (semester II) about 24 billion VND (high school about 10.7 billion VND; middle school 13.3 billion VND). The estimated cost for the following school years is 165 billion VND (33 billion VND/school year).
Circular 29 of the Ministry of Education and Training stipulates that extra teaching in schools cannot be charged, extra teaching outside of schools must meet certain conditions.
