Within the protection corridor of river banks, canals, ditches, lakes, ponds, people are allowed to build limited-term service facilities such as sports fields (soccer, tennis, pickleball...), cafes, playgrounds, advertising areas...

That is the content of Decision No. 56 promulgating regulations on management and use of protection corridors on river banks, canals, ditches, lakes and ponds in Ho Chi Minh City, recently issued by the Ho Chi Minh City People's Committee.

This Decision takes effect from April 28, 2025. This Decision replaces Decision No. 22 (dated April 18, 2017) of the Ho Chi Minh City People's Committee on the management and use of corridors on river banks, streams, canals, ditches and public lakes in Ho Chi Minh City.

Basically, the new regulation is similar to the content of the 2017 regulation.

Accordingly, within the corridors of rivers, streams, canals, ditches and public lakes, technical infrastructure works can be built to ensure national defense and security and fire prevention and fighting.

However, the new regulations provide more specific regulations on the term of use and licensing for groups of works serving limited-term service activities such as: outdoor exhibitions, outdoor entertainment areas, billboards, Tet flower markets;

Outdoor coffee and beverage outlets, tourist business locations; sports facilities (such as soccer fields, tennis courts, pickleball courts...).

According to the new regulations, the term of use of the above works is determined according to the approved planning and land use plan of the area.

In case there is no land use planning or plan, the maximum period is 1 year and can be considered for extension if there is no notice (or decision) to reclaim the land.

The investor of this project must dismantle it himself without compensation when the term of use expires or when the State reclaims the land to build the project according to the provisions of the law on land.

For projects with a usage period of less than 90 days, the District People's Committee shall consider and decide.

For projects with a usage period of 90 days or more, the District People's Committee shall preside over and coordinate with relevant professional agencies to review and submit to the City People's Committee for decision.

Previously, according to Decision No. 22/2017, the term of use of works serving service activities was 3 years.
