The Ministry of Construction said it is considering immediately eliminating construction permit procedures in areas that already have a 1/500 plan or urban design.

Ministry of Construction will abolish construction permits

At a recent Government press conference, Deputy Minister of Construction Nguyen Danh Huy said that the ministry will study and amend regulations to exempt licensing for areas that already have urban design or detailed planning 1/500. According to Mr. Huy, these areas can use urban design for state management, so construction permits for people can be immediately abolished.

However, Mr. Huy also said that the abolition needs to be carefully evaluated to ensure harmony between people's rights and management requirements, without causing negative impacts on the community.

Speaking with Tuoi Tre Online , Savills Vietnam said that reforming construction licensing procedures is a positive move, especially for real estate development businesses in the current context.

In fact, the process of obtaining a construction permit often takes from 3 to 6 months, or even longer if the project has to adjust the planning or seek opinions from many authorities.

Prolonged procedures not only affect implementation progress but also increase financial costs, putting pressure on capital flow and business turnaround capabilities.

According to Savills Vietnam, the proposal to exempt construction permits for projects that have detailed planning at 1/500 scale or are located in areas with approved urban design is a reasonable step. For these projects, technical indicators such as construction density, height, setbacks or infrastructure have been specifically determined, so the construction registration mechanism can be applied instead of the traditional licensing process while still ensuring compliance and supervision.

Construction procedures should be minimized.

Ms. Giang Huynh - representative of Savills Ho Chi Minh City - said that shortening procedures will help businesses optimize operations, bring products to the market at the right time and use resources more effectively. Overall, this is a reform that can contribute to improving the investment environment and promoting legal supply to the market.

"This policy needs to be implemented simultaneously with a strict post-inspection system. To ensure comprehensive effectiveness, it is necessary to promote digitalization, build a centralized data system to track progress, supervise construction quality and publicize inspection results," said Ms. Giang Huynh.

Meanwhile, Mr. Nguyen Quoc Hiep - Chairman of the Vietnam Association of Construction Contractors (VACC) - said that it is necessary to reduce other legal procedures, for example, cutting down on investment licensing steps and adjusting construction licensing planning.

According to Mr. Hiep, in the field of real estate investment, there needs to be an agency that unifies mandatory procedures and simplifies the investment process to guide businesses in implementation.

"Every six months, localities need to have meetings with investment, production and business enterprises in the area in each field. Enterprises will give suggestions to the government apparatus on administrative procedures that need to be learned from and changes in management and operation," said Mr. Hiep.

Not all houses are exempt from building permits.

Speaking to Tuoi Tre Online , real estate expert Le Quoc Kien said that the abolition of construction permits will be applied to areas that have been detailed planned at 1/500 scale, or areas that have approved urban designs. This means that not all houses will have their permits removed when they are built.

According to Mr. Kien, the places where detailed planning is clear and complete, usually in new areas, have a checkerboard-style planning, have internal roads, and the construction criteria are very clear from the beginning when the investor sets up the project...

The second case is in areas that have been approved for urban design, which means that they have all the construction standards as in the 1/500 project area, but are located in long-term residential areas. This case is currently not common in Ho Chi Minh City, only in a few main road frontages, such as Pham Van Dong.

Therefore, Mr. Kien believes that it is necessary to promote the approval of urban designs. However, the ability to deploy deep into long-standing alleys still has many shortcomings and variables, which can easily cause many negative consequences that must be dealt with later...
