Accordingly, maternity benefits are a notable new feature of the 2024 Social Insurance Law, thereby expanding benefits to millions of freelance workers, informal workers, small traders, farmers, and freelancers across the country.
Conditions for receiving benefits
People who have paid voluntary social insurance for at least 6 months in the 12 months before giving birth will receive benefits if they fall into one of the following cases: Female workers giving birth; male workers whose wives give birth; fathers or the person directly raising the child in case the mother dies after giving birth. In case both the father and mother are eligible, only one person will receive maternity benefits. If the employee is eligible for both compulsory social insurance and voluntary social insurance, he/she will only receive benefits under the compulsory social insurance regime.

Maternity benefit level
Regarding the maternity allowance for voluntary social insurance participants, it will be 2 million VND for each child born, or each fetus from 22 weeks old or older that is stillborn or dies during labor. In addition, female workers who are ethnic minorities or Kinh women whose husbands are ethnic minorities in poor households will also enjoy other support policies according to Government regulations.
The source of payment for maternity allowance for voluntary social insurance participants is guaranteed by the State budget. The Government will decide to adjust the allowance level in accordance with the socio -economic development conditions and the State budget capacity in each period.
According to Vietnam Social Security, the addition of maternity benefits for voluntary social insurance participants marks a new step forward in Vietnam's social security policy. Thereby, it aims to achieve the goal of universal social insurance coverage, while at the same time creating incentives to encourage informal workers to proactively participate in social insurance, gradually ensuring a stable life when they are old and when facing risks.
Local social insurance agencies are now ready to advise, guide and receive workers to register for voluntary social insurance with flexible contribution levels, suitable to their income. This is a practical opportunity for self-employed workers to be better protected against risks in life and have more financial support when having children. |
