According to Article 49 of the 2013 Law on Employment, employees specified in Clause 1, Article 43 of the 2013 Law on Employment who are paying unemployment insurance are entitled to unemployment benefits when meeting all conditions.
According to Article 49 of the 2013 Law on Employment, employees specified in Clause 1, Article 43 of the 2013 Law on Employment who are paying unemployment insurance are entitled to unemployment benefits when they meet the following conditions:
- Termination of labor contract or employment contract, except in the following cases:
+ Employees unilaterally terminate labor contracts or work contracts illegally;
+ Receive monthly pension and disability benefits;
- Having paid unemployment insurance for at least 12 months within 24 months before the termination of the labor contract or work contract in the cases specified in Point a and Point b, Clause 1, Article 43 of the 2013 Law on Employment;
Having paid unemployment insurance for at least 12 months within 36 months before the termination of the labor contract in the case specified in Point c, Clause 1, Article 43 of the 2013 Law on Employment;
- Have submitted an application for unemployment benefits at the employment service center as prescribed in Clause 1, Article 46 of the 2013 Law on Employment;
- Not finding a job after 15 days from the date of submitting the application for unemployment insurance, except in the following cases:
+ Perform military service and police service;
+ Studying for a period of 12 months or more;
+ Comply with the decision to apply measures to send to a reformatory school, compulsoryeducation facility, or compulsory drug rehabilitation facility;
+ Being detained; serving a prison sentence;
+ Settling abroad; working abroad under contract;
+ Dead.
Thus , from the above regulations, employees who quit their jobs to participate in military service will not receive unemployment benefits.
