Research on applying regulations on rewards and penalties for traffic infrastructure projects

Accordingly, in Notice No. 162/TB-VPCP dated April 28, 2023, the conclusion of Deputy Prime Minister Tran Hong Ha at the meeting to implement the Long Thanh International Airport Project stated: The Prime Minister issued Decision No. 401/QD-TTg dated April 18, 2023 to establish the Working Group for the Long Thanh International Airport Construction Investment Project Phase 1 (Working Group).

The relevant ministries and branches, as members of the Working Group, shall promote a high sense of responsibility, in accordance with their assigned authority, functions and tasks, with a democratic spirit in the process of exchange and discussion to advise and propose to the Prime Minister for timely direction; demonstrate the sense of responsibility of the Working Group members before the Government and the people; comply with the decisions and instructions of the Head of the Working Group.

Notably, for package 5.10, the Deputy Prime Minister requested that within 1 week from April 24, 2023, Vietnam Airports Corporation (ACV), in a spirit of openness and responsibility, continue to review, research, and absorb to complete the bidding documents, avoiding incomplete and loose bidding documents causing difficulties for the bidding process.

Along with that, invite experienced domestic and international experts to ensure that the bidding documents have strict criteria, scientific , simple and easy-to-evaluate evaluation methods with full criteria on techniques, technology, modernity, sustainability, actual capacity of the contractor, bidding price, aviation equipment technology, etc. (consider adding criteria for evaluating contractors with bad precedents, violations of quality, progress, capital overruns, etc.) to select domestic and international contractors with capacity, experience and reputation. Note that bidding price is an important criterion, but the evaluation of this criterion must not affect the quality, progress and sustainability of the project.

ACV proactively decided to extend the bid opening time to 6 weeks and supplement the bidding documents on the feasible advance payment rate for construction contracts, equipment supply and installation according to international practices and regulations of Vietnamese law. At the same time, research and apply regulations on rewards/penalties for traffic infrastructure projects in cases where contractors construct earlier/later than required progress to encourage capable contractors, applying scientific and technical advances in construction management and operation. There are clear regulations to prioritize domestic contractors with capacity and experience to participate, especially in construction and installation.

Regarding the evaluation of bidding documents and drafting of contracts, the Deputy Prime Minister requested ACV to conduct public, transparent evaluations in accordance with legal regulations to select the best contractor, ensuring strict legal compliance.

The Deputy Prime Minister requested the ministries of Transport, Construction, State Capital Management Committee at Enterprises, ACV and relevant agencies to organize implementation according to the recommendations of the Ministry of Planning and Investment in Official Dispatch No. 2544/BKHĐT-QLĐT dated April 7, 2023, ensuring the selection of contractors with sufficient capacity and experience to implement package 5.10.

The Ministry of Transport shall direct the selection of service and logistics providers in the airport area to be implemented within its authority and in accordance with legal regulations; it is important to select investors with full capacity, experience, and reputation to provide the best and most effective services that meet national and international standards. After selecting investors, land allocation and lease shall be carried out in accordance with the provisions of the law on land and relevant laws.
