Many new points in the regulations for establishing universities

TPO - Decree No. 125/2024/ND-CP of the Government regulating investment and operation conditions in the education sector has many new points.

Regarding the field of higher education, Decree 125 introduces a number of new points compared to Decree 46 issued in 2017 by the Government (amended and supplemented in Decree No. 135 issued in 2018).

Accordingly, Decree 125 has supplemented regulations on conditions, authority, and procedures for recognizing regional universities and national universities.

This is to implement the Resolutions of the Politburo , as well as to be consistent with the role, position, and function of regional universities and national universities; to form regional universities and national universities on the basis of recognizing universities as regional universities or national universities (these universities have been established and are operating according to regulations, so raising the issue of re-establishment is inappropriate).

The formation of regional and national universities in this direction aims to take advantage of the available resources, achievements and advantages of universities, to ensure that immediately after being formed, regional and national universities have sufficient conditions to perform their assigned functions, tasks and missions.

Regarding establishment, Decree 125 requires that universities must have an establishment project in accordance with the approved planning of the network of higher education and pedagogical institutions. There must be a written approval for the establishment of the school in the province or centrally-run city from the provincial-level People's Committee where the school has its headquarters (except for schools under the provincial-level People's Committee) and confirmation of land use rights.

Regarding land, the regulation requires that the land area for building the school at the main campus must be at least 5 hectares. A requirement of the old decree that the average minimum area is 25 square meters per student at the time the school has a stable training scale after 10 years of development is no longer in this decree.

The land provision has a new provision that the school construction site must ensure a safe educational environment for students, teachers, managers and staff; must not be located near service establishments, production facilities, warehouses that pollute the environment, are toxic, have a direct risk of fire or explosion and must not be located in a dangerous warning area.

For the establishment of private universities, the new regulations still require a minimum investment capital of 1,000 billion VND (excluding the value of land for school construction). At the same time, the investment capital is determined by cash and assets prepared for investment and confirmed in writing by the competent authority; by the time of appraisal for permission to establish, the investment value must be over 500 billion VND.

Regarding the establishment of a branch of a public university or permission to establish a branch of a private university, the regulation on the minimum construction land area is still 2 hectares as in the old regulation, but the new requirement is not to be located near service establishments, production facilities, warehouses that pollute the environment, are toxic, have a direct risk of fire or explosion, and are not located in a dangerous warning area.
