On the morning of November 25, Deputy Prime Minister Ho Quoc Dung chaired a meeting with ministries, ministerial-level agencies, and Vietnam Electricity Group to give comments on the draft Decision of the Prime Minister to abolish a number of legal documents of the Prime Minister.
At the meeting, Deputy Minister of Justice Phan Chi Hieu, representative of the agency in charge of drafting the draft, said that recently, a number of ministries, ministerial-level agencies, and localities have reviewed and discovered that a number of legal documents issued by the Prime Minister are no longer applied in practice, but there is no legal basis to determine their expiration according to the provisions of the Law on Promulgation of Legal Documents. In principle, these documents are still determined to be "still in effect".
Therefore, to ensure the publicity and transparency of the legal system, and at the same time ensure compliance with the provisions on the validity of documents according to the Law on Promulgation of Legal Documents No. 64/2025/QH15 (amended and supplemented by a number of articles under Law No. 87/2025/QH15), Decree No. 78/2025/ND-CP dated April 1, 2025 of the Government detailing a number of articles and measures to organize and guide the implementation of the Law on Promulgation of Legal Documents (amended and supplemented by Decree No. 187/2025/ND-CP), it is necessary to issue documents to abolish the above documents.

On April 8, 2018, the Government issued Resolution No. 23/NQ-CP on the regular Government meeting in March 2018, in which the Government assigned the Ministry of Justice to preside over and coordinate with relevant ministries and agencies to develop legal documents to terminate the validity of documents issued by the Prime Minister that are no longer applied in practice but have not yet been determined to be no longer valid.
The Ministry of Justice has issued a Decision to establish a Drafting Team for the Prime Minister's Decision and organized a meeting of the Drafting Team, working with relevant ministries, branches and units to discuss and agree on the content of the draft Decision.
The purpose of promulgating documents is to terminate the validity of legal documents that are no longer applied in practice but have not been determined to be no longer valid according to the provisions of the Law on Promulgation of Legal Documents, in order to ensure the publicity and transparency of the legal system.
According to the Ministry of Justice, the content of the draft Decision stipulates the abolition of a number of documents of the Prime Minister that are no longer applicable in practice, does not stipulate new policies or amend or supplement existing policies in the documents, therefore, does not create additional human and financial resources in the implementation and enforcement of the Decision after it is issued by the Prime Minister.

Check carefully to ensure tightness, no omissions
Concluding the meeting, Deputy Prime Minister Ho Quoc Dung requested the Ministry of Justice to preside over and coordinate with ministries to conduct a final thorough review and complete the dossier to submit to the Government in December 2025. The Deputy Prime Minister emphasized that the ministries have agreed on the necessity of issuing the above Decision, but it is necessary to review it carefully to ensure completeness and accuracy before submitting it for signature.
The Deputy Prime Minister assigned the Ministry of Justice to preside over and coordinate with the Ministry of Industry and Trade to continue to inspect and carefully review documents under the authority of proposing to abolish, ensuring that no documents that are no longer in effect in practice but are still identified as "in effect" are omitted. The requirement is that the review process must be strict, avoiding the situation where the content is still entangled or inconsistent between ministries and agencies.
The Deputy Prime Minister emphasized that completing the Decision to abolish inappropriate legal documents is an important task to ensure transparency and consistency of the legal system, while facilitating State management and the activities of people and businesses.
