The political system and people in the whole country in general and Binh Thuan in particular are very interested in controlling power, preventing and fighting corruption and negativity in personnel work.
Therefore, this issue has become even more topical when the Politburo recently issued Regulation No. 114-QD/TW on controlling power and preventing corruption and negativity in personnel work. This regulation clearly affirms the Party's determination in personnel work, strengthening and consolidating people's trust.
Replacement needed
Previously in 2019, the Politburo issued Regulation 205 on controlling power in personnel work and preventing the abuse of power and position. After 3 years of implementation, the regulation has brought about many remarkable results. That is, local ministries and branches piloted innovation in selecting leaders and managers at department, agency and division levels in an objective, public and transparent manner with 438 positions. Mobilized and rotated 9,000 cadres; proposed not to consider 251 turns of cadres under the Central management who did not meet the standards and conditions. At the same time, 50 cases of family relationships were discovered to hold related positions to mobilize, assign and arrange other suitable positions; handled responsibilities for violations in personnel work, including suspending 5 cases from work and positions; Temporarily suspending, according to regulations of competent authorities, the planning, mobilization, and rotation of 190 cases... The regulations have gradually overcome the situation of abuse of power, abuse of power, manipulation in personnel work, covering up, and assisting in personnel work.
However, in reality, personnel work in recent times has been limited, weak, even corrupt and negative. The situation of running for positions, running for power, running for age, running for planning, running for rotation, running for degrees, running for rewards, running for titles, running for crimes... has not been completely prevented and pushed back.
Faced with this situation, Regulation No. 114 replaces Regulation No. 205 of the Politburo on controlling power in personnel work and preventing the abuse of positions and power. The regulation consists of 5 chapters and 16 articles; which stipulates negative acts of corruption in personnel work; responsibilities for controlling power and preventing and combating corruption and negativity in personnel work; handling violations... The subjects of application of Regulation 114 are organizations and individuals with authority, responsibility and involvement in personnel work. Regulation 114 clearly states acts of taking advantage of and abusing positions and powers. Specifically, the regulation "incorporating personal intentions when performing stages in personnel work for the motive, purpose of profit or benefiting personnel in the process of performing personnel work"; "When receiving petitions, letters of reflection, denunciation or knowing that personnel have corrupt or negative behavior in personnel work but compromise, hesitate, cover up, do not handle according to authority, handle not in accordance with regulations or do not report to competent authority for handling".
In the 6 acts of seeking positions and power, Regulation 114 has a new act of "seeking age, seniority, emulation titles, rewards, degrees, assignments, appointments, nominations, designations, transfers, rotations, secondments, military rank promotions... for the purpose of meeting the standards, conditions, and obtaining positions and benefits".
Regulation 114 also adds a number of other negative behaviors. Specifically, such as the behavior of "lack of responsibility or personal motives causing loss or damage to personnel records under management authority"; "falsifying or falsifying records and documents for consideration and implementation of regulations, processes, rules and decisions on personnel work". Or such as the behavior of "reporting, creating records, declaring party member records, cadre records, especially personal and family history that are incomplete or dishonest"...
Do not assign family members to hold several positions at the same time.
Notably, to strengthen the prevention and control of the abuse of power in personnel work, Regulation 114 clearly states that people with family relationships must not be assigned to hold related positions at the same time, including: Members of the same standing committee of the Party Committee, Party executive committee, Party delegation, collective leadership of agencies and units; heads and deputy heads of the same locality, agency, unit; heads of agencies in 13 sectors. These are the sectors: Home Affairs, Inspection, Finance, Banking, Tax, Customs, Industry and Trade, Investment Planning, Natural Resources and Environment, Military, Police, Courts and Procuracies at the Central level or at the same level in a locality...
In case there is no personnel plan that meets the requirements and the personnel is a highly trusted family member, it must be reported to and approved by the immediate superior Party Committee before being arranged.
Recently, at the Conference to disseminate and implement the newly issued regulations of the Politburo and the Secretariat on Party building and organization, Standing member of the Secretariat and Head of the Central Organization Committee Truong Thi Mai noted that sectors, localities and Party organizations need to strictly implement Regulation 114, especially not to arrange people with family relationships to simultaneously hold related positions, including 13 sectors specifically mentioned. The Head of the Central Organization Committee said that this is a difficult regulation because it affects people, thoughts, feelings and desires. The Standing member of the Secretariat requires leaders and managers to consider it fully and set an example. Prohibitive regulations cannot be implemented, while exemplary requirements must be carefully considered and calculated. “Everyone wants their children and family members to grow up and develop. That desire is completely legitimate. It’s just that if you are a leader or a manager, you must consider it carefully and set an example,” said Ms. Truong Thi Mai.
Regulation 114 also clearly states the responsibility of personnel to promptly, fully, accurately and clearly report the personal records of party members, cadres, civil servants and public employees and honestly declare assets and income according to regulations; voluntarily not run for election, not accept nomination, planning, appointment, conferment, promotion of ranks, rewards, regimes and policies if they themselves do not meet the standards, conditions, qualities, prestige, capacity and health. Regarding the responsibility to prevent and combat corruption and negativity in personnel work, the Politburo also issued a series of regulations, including the timely protection and reward of individuals who detect, reflect, provide information and correctly denounce acts of corruption and negativity in personnel work; at the same time, strictly handle those who make false accusations that affect the reputation of others.
The promulgation of the regulation is a very important decision, not only creating fairness and transparency in personnel work, but also strengthening people's trust in the Party and State, strengthening national solidarity, and strengthening the true strength of the political system.
Standing member of the Secretariat, Head of the Central Organization Committee Truong Thi Mai emphasized: “… this is a difficult regulation, because it affects people, thoughts, and feelings, so leaders and managers must consider it carefully and set an example. Prohibited regulations must not be implemented…”. Regulation 114 takes effect from July 11, 2023, replacing Regulation No. 205-QD/TW, dated September 23, 2019 of the Politburo.
