This morning, in Hanoi, a national scientific workshop took place on "Improving the structure of Vietnam's legal system to meet the requirements of national development in the new era".
Comrade Phan Dinh Trac, Politburo member, Secretary of the Party Central Committee, Head of the Party Central Committee's Internal Affairs Commission; Deputy Prime Minister Le Thanh Long, Vice Chairman of the National Assembly Nguyen Khac Dinh, Chairman of the National Assembly's Committee for Law and Justice Hoang Thanh Tung, Minister of Justice Nguyen Hai Ninh co-chaired the workshop with the participation of leaders of departments, ministries, branches, experts and scientists.
Many modern legislative techniques have been absorbed and applied in Vietnam.
Speaking at the opening of the workshop, Deputy Prime Minister Le Thanh Long said that this is an important event, contributing to clarifying theoretical aspects, identifying practical issues, and referring to international experience to achieve the goal of making institutions and laws a competitive advantage, playing a leading role in national development.
According to the Deputy Prime Minister, the institutional and legal system is an important factor that determines the success or failure of each country. In recent years, the Party and State have always paid special attention to the work of building and perfecting institutions and laws, identifying this as one of the three strategic breakthroughs; issued and effectively implemented many innovative policies, guidelines, mechanisms and policies, improved the effectiveness of law-making and enforcement and achieved many important results.
In particular, we have issued Resolution 27 on building a socialist rule-of-law state and Resolution 66 on innovating the work of building and enforcing laws. These are historic policies, guiding the development of the Vietnamese legal system in the recent past and in the future.
Deputy Prime Minister Le Thanh Long emphasized that Vietnam has established a basic and quite complete legal framework; the basic legal system meets the need to regulate social relations in most areas of social life with nearly 300 laws, codes, ordinances and many other sub-law documents still in effect.
The work of building and enforcing laws has been innovated in both thinking and working methods; shifting from a mindset that is somewhat inclined towards centralized management to proactive leadership, from handling each case to creating a long-term legal corridor. Many mechanisms and policies have been issued, promptly removing many "bottlenecks" in the legal system, handling many difficulties and obstacles in the development process.

The legal system has established a hierarchy between types of documents with a clear and appropriate basic legal effect hierarchy, helping to establish a legal order in regulating the behavior of subjects in society, ensuring the constitutionality and legality in the construction, drafting, appraisal and examination of legal documents.
Many modern legislative techniques have been adopted and applied in Vietnam such as: Assessing policy impacts; consulting experts and people; ensuring compatibility with international treaties, taking into account the factor of harmonization with progressive legal practices in countries around the world, especially in areas such as civil-economic-commercial law, investment, intellectual property, competition, personal data protection, etc.
However, the work of building and perfecting laws still has limitations and shortcomings. Some of the Party's policies and orientations have not been institutionalized promptly and fully, or have been institutionalized but their feasibility is not high; the thinking of building laws in some fields is still inclined towards management; the quality of building and perfecting laws has not really met practical requirements, has not really created a truly favorable environment to promote innovation; decentralization, delegation of power, and digital transformation in building laws are still inadequate and have not received due attention.
In particular, in response to the requirements of national development in the new period, the current legal system needs to be reviewed and evaluated to continue to improve both its content and structure in a modern and reasonable direction, ensuring coverage of emerging industries and fields and new development trends, contributing to building a synchronous, unified, transparent, feasible, and constructive legal system, building a favorable investment and business environment, ensuring the legitimate rights of people and businesses.
Clarifying the theoretical basis and foundation for perfecting the structure of the legal system
In that context and requirement, at today's Workshop, Deputy Prime Minister Le Thanh Long requested agencies, experts and scientists to participate, contribute ideas and propose initiatives for the process of continuing to build and perfect the legal system; focusing on discussing and clarifying some important contents. That is to clarify the theoretical basis and foundation for perfecting the structure of the legal system to meet the development requirements in the new period.
"Is there anything that needs to be supplemented or developed in the theoretical foundations we have used to build and perfect the Vietnamese legal system?", the Deputy Prime Minister asked.

Assess the current status of the structure of Vietnam's legal system, clarifying: The extent of coverage of areas of social life and the conformity with the requirements of innovation in law-making thinking; the full identification of legal sources or forms; the division of law into sectors and fields; the maintenance of discipline and order and the requirement to ensure the constitutionality and legality of legal documents; the relationship between national law and international law; legislative techniques, enforcement capacity...
It is necessary to specifically identify directions, solutions, and roadmaps for perfecting the structure of Vietnam's legal system to overcome limitations and shortcomings, and build a more complete legal system structure so that the State and its subjects can properly promote their roles, positions, and responsibilities in the country's development process.
"With a high sense of responsibility and determination to innovate, we believe that today's workshop will achieve practical and effective results, making an important contribution to the process of perfecting the structure of Vietnam's legal system in the country's new development stage," said Deputy Prime Minister Le Thanh Long.
