Minister of Agriculture and Environment Do Duc Duy has just sent an official dispatch to the Steering Committee for the implementation of the Project on the arrangement and consolidation of provincial-level administrative units; People's Councils and People's Committees of provinces and centrally-run cities to carry out the merger on reviewing regulations in the field of land when organizing two-level local governments.
According to the content of the dispatch, the 2024 Land Law and the decrees detailing the implementation of the law have many contents assigning the People's Council and People's Committee at the provincial level to issue detailed regulations and implementation instructions to apply appropriately to specific conditions in each locality.
In recent times, localities have focused all resources on developing and issuing documents as required. However, after merging provinces and cities, there may be a situation where there is inconsistency within the province or city regarding some specific regulations.
Specifically, according to the Ministry of Agriculture and Environment, inconsistent regulations appear in the following contents: Time to carry out administrative procedures, compensation levels for livestock and crops, support levels for stabilizing life and production, minimum resettlement rate, unit price for compensation for damages when the State reclaims land; land allocation limits, recognition of land use rights.
In addition, the conditions and minimum area for land division and land consolidation for each type of land; or the criteria for deciding to conduct bidding to select investors to implement investment projects using land,... may also lead to a situation of comparing advantages and disadvantages between communes, wards, or between land users, thereby causing difficulties for land management at the local level.
To proactively overcome the above shortcomings, the Steering Committee for the implementation of the Project on the arrangement and consolidation of provincial-level administrative units, People's Councils and People's Committees of provinces and cities, needs to direct specialized agencies to proactively review the assigned contents detailing the implementation of the Land Law and decrees detailing the implementation of the law under their authority, to amend and supplement in the direction of uniformly regulating the application or regulating the application of specific policies at the local level after the merger.
In particular, the Ministry of Agriculture and Environment requested the Steering Committee to develop a Project to arrange and merge provincial-level administrative units and localities to have transitional regulations to implement land policies in the provincial area when the merged provincial-level administrative units come into operation, ensuring no interruption, no legal gaps, and no impact on the rights and legitimate interests of land users./.
