New fees will be applied for real estate brokerage certificates

According to the Ministry of Finance, on August 8, 2025, the Ministry of Construction sent an official dispatch to the Ministry of Finance requesting the development of this Circular. Currently, the fee for granting a real estate brokerage practice certificate is under the authority of the Ministry of Finance according to the Law on Fees and Charges. The Law on Real Estate Business assigns the Ministry of Construction to manage the granting of certificates and brokerage activities, but the fee for granting certificates is paid directly by individuals to the Provincial People's Committee according to Decree 96/2024/ND-CP.

In recent times, localities have organized exams, issued and reissued real estate brokerage practice certificates. However, the fee collection level for this activity has not been issued, causing confusion in the implementation process. Therefore, the Ministry of Construction has sent a proposal to the Ministry of Finance to develop a Circular to specify the collection level, collection and payment regime of fees.

The Ministry of Finance said that the issuance of the Circular is necessary to create a legal basis for the collection and payment of certificate fees, while ensuring consistency and uniformity with the law on real estate business, the law on fees and charges as well as the state budget. The draft content is built in accordance with current legal regulations, ensuring clarity, ease of understanding and implementation.

According to the Ministry of Construction's proposal, the actual cost of issuing each real estate brokerage practice certificate is currently around VND307,991/file. On that basis, the Ministry of Construction proposed a fee of VND300,000/certificate for new issuance and VND200,000/certificate for re-issuance. This level is equivalent to the fee for issuing practice certificates in some other fields such as archiving (VND300,000 for new issuance, VND200,000 for re-issuance).

Based on the proposal of the Ministry of Construction and pursuant to Article 9 of the Law on Fees and Charges (the fee level does not cover all actual costs), the Ministry of Finance has proposed the corresponding fee level: VND 300,000 for each newly issued certificate and VND 200,000 for each reissued certificate. In case of reissuance due to the fault of a state agency or due to a change in administrative boundaries according to the decision of a competent authority, individuals will not have to pay the fee.

The issuance of this circular will contribute to perfecting the legal basis, facilitating individuals in the process of granting and re-granting real estate brokerage practice certificates, and at the same time supporting transparent and unified management of fee collection and payment nationwide.
