Accordingly, on the afternoon of May 20, the Department of Health presided over and coordinated with relevant departments and branches to inspect food safety at Nestlé Vietnam Company Limited (Bien Hoa 2 Industrial Park, Bien Hoa city).
The delegation focused on inspecting Nestlé Milo barley milk supplement products; checking the company's legal documents; self-declaration of products; product labeling; advertising; taking food samples to test food safety and quality indicators.
Regarding the content related to the use of information from the Institute of Nutrition to advertise products, the inspection team noted that according to the cooperation contract No. MKT-2023.0199 dated November 9, 2023 between the Institute of Nutrition (Party A) and Nestlé Vietnam Company Limited (Party B), the content is: "In order to disseminate research results, Party A agrees to let Party B and related brands communicate part or all of the results of the research topic with the annotation "Clinically tested by the Institute of Nutrition" along with the corresponding decision number recognizing the results of the research topic attached. And allows Party B to use communication messages built from the results of the research topic with this annotation as communication information on media and communication channels; newspapers, television, social networks, packaging, conferences, printed and electronic documents... within the framework of the law".
On November 2, 2023, Nestlé Vietnam Company Limited sent a document to the Department of Grassroots Culture (Ministry of Culture, Sports and Tourism) regarding the introduction of the Institute of Nutrition and other scientific and technological organizations with nutritional research functions in contents related to research on food products.
On November 16, 2023, the Department of Grassroots Culture responded in writing. The document stated: “According to the provisions of Clause 1, Article 19 of the Law on Advertising, “advertising content must ensure honesty, accuracy, clarity, and not cause damage to producers, traders, and direct recipients of advertisements”. Thus, the Company's introduction of research results, scientific project names, names of the National Institute of Nutrition, and Ho Chi Minh City Institute of Nutrition as a unit supporting the implementation of scientific research on product features and uses on media and product packaging is in accordance with the requirements of honesty, accuracy, clarity, and avoiding confusion for advertising recipients as prescribed in Clause 1, Article 19 of the Law on Advertising”.
The inspection team of the Department of Health noted that at the time of inspection, the company had an investment certificate, a business registration certificate, a certificate of food safety eligibility; FSSC 22000 certificate; the owner and employees participating in production were examined for health and trained in food safety knowledge.
The inspection team requested the company to continue to cooperate to clarify some other related contents and no conclusions were reached at the time of inspection.
According to Decision No. 530/QD-SYT dated May 20, 2025 of Dong Nai Department of Health on food safety inspection at Nestlé Vietnam Company Limited, the inspection period is 30 days, starting from 1:30 p.m. on May 20, 2025.
