The National Assembly has officially passed a Resolution on amending and supplementing a number of articles of the 2013 Constitution. To better understand this issue, the reporter had an interview with Lawyer Bui Van Thanh - Head of the New Sun Law Office, Vice President of the Vietnam Industrial Park Finance Association.

- The National Assembly has officially passed the Resolution on amending and supplementing a number of articles of the 2013 Constitution. The content of this amendment and supplement to the Constitution focuses on 8/120 articles of the 2013 Constitution. These are the core contents, decisive in implementing the policy on restructuring and streamlining the apparatus. How do you evaluate the Resolution of the National Assembly on amending the Constitution?
Lawyer Bui Van Thanh: Vietnam is standing on the threshold of a new era of development, an era of national growth, with the aspiration to become a developed country with high income by 2045. However, there are bottlenecks, major "bottlenecks" that are hindering the goal of strong and sustainable development, in which "institutions" are considered the "bottleneck" of "bottlenecks", the "bottleneck" of "bottlenecks".
Therefore, this innovation needs to be carried out comprehensively and substantially in terms of institutions, creating political consensus and arousing national aspirations, daring to think big, daring to do big, effective, dynamic, creative, and developing society. From there, build a real rule of law state, fundamentally innovate the institution from "control" and "management" to a legal institution leading development.
In my opinion, amending the 2013 Constitution is a correct policy of the state, a breakthrough decision, demonstrating the strong determination of the political system, in line with the aspirations of the nation and all Vietnamese people, so that Vietnam is ready in mind, position and strength to enter the new era.
Resolution 194/2025/QH15 of the National Assembly decided to consider amending and supplementing 8/120 articles of the 2013 Constitution to implement the policy of streamlining the organization of the political system, including the Vietnam Fatherland Front , socio-political organizations and the demarcation of administrative units and local government organizations.
The laws need to be amended and supplemented to effectively and substantially implement four institutional breakthroughs, including: Breakthrough in science, technology, innovation and national digital transformation; breakthrough in private economic development; international integration in the new situation; innovation in law making and enforcement.
However, regarding legality and authority, according to Articles 120 and 119 of the 2013 Constitution, the National Assembly is the only body with the right to amend the Constitution and the amendment must be approved by at least 2/3 of the total number of delegates. Currently, the National Assembly is only seeking public opinion on the amendment and supplementation of these 8 articles, and has not yet conducted a comprehensive amendment of the 2013 Constitution.

- Many opinions believe that amending and supplementing a number of articles of the 2013 Constitution at the present time is extremely necessary, creating a basis for implementing the revolution of streamlining the organizational apparatus, building, perfecting, and improving the efficiency of the political system, meeting the requirements and tasks of rapid and sustainable national development in the new era, the era of striving to develop richly, strongly, and prosperously of the nation. What is your opinion on this issue?
Lawyer Bui Van Thanh: My point of view agrees with the assessment that amending and supplementing a number of articles of the 2013 Constitution at the present time is an inevitable and urgent requirement, completely legitimate and necessary, stemming from both the country's internal needs and the strong changes of the times, "paving the way" for the second institutional reform, helping the country overcome the bottleneck, break through into the era of development. However, that process needs to be carried out with a cautious, scientific, open-minded spirit and, above all, must put national interests and ethnic interests first.
The Constitution is not only the original law regulating the organization and operation of state power, but also the "compass" for institutional reforms and national governance. As Vietnam enters a new stage of development, shifting from "developing" to the goal of "developed country", perfecting the constitutional framework becomes a prerequisite. Amending and supplementing the corresponding provisions of the Constitution is the fundamental basis for innovating the political apparatus, streamlining the organization, building and improving the effective operation of a modern political system compatible with the new development context.
- As a lawyer and businessman with many years of experience in the development of the private economic sector, in your opinion, Resolution 68-NQ/TW of the Politburo on Private Economic Development and Resolution 194/2025/QH15 of the National Assembly on amending and supplementing a number of articles of the 2013 Constitution will create favorable conditions for the development of the private economy in the coming time?
Lawyer Bui Van Thanh: In the new context, in order for the economic scale, position of Vietnam's economy in the world economic rankings and per capita income rankings to improve, it is clear that Vietnam only has the path of economic development, breakthrough in private economic development, and maintaining a high annual economic growth rate to avoid falling behind and to achieve the goal of being a developing country with per capita income equal to or greater than 18,000 USD.
Therefore, I believe that Resolution 68-NQ/TW is a breakthrough in thinking with specific goals and solutions for private economic development. The Resolution has created confidence and strong motivation for entrepreneurs, creative enterprises, and business investment. From there, it will mobilize unlimited domestic and foreign resources to develop Vietnam's private economy, realizing the noble goal of a rich people and a strong country.
I believe that Resolution 68, along with other pillars such as the Resolution on breakthroughs in science, technology, innovation and national digital transformation, the Resolution on international integration in the new situation, and innovation in law making and enforcement, will create new, strong and effective driving forces for the development of Vietnam's private economy.
Resolution 194/2025/QH15 of the National Assembly deciding to consider amending and supplementing 8/120 Articles of the 2013 Constitution is a wise and important decision, with a constitutional constitution that is a breakthrough in thinking with specific goals and solutions for private economic development. I hope that the approved contents will be implemented with a cautious, scientific, open-minded spirit and, most importantly, must put national and ethnic interests first, as a fundamental and solid legal foundation for the development of Vietnam's private economy.
