Creating a legal corridor for non-public research units to access state resources

To specify Resolution 57-NQ/TW, Article 37 of the Law on Science, Technology and Innovation affirms the right of non-public organizations to participate equally in research tasks using the budget. This is considered a step forward to open the door to cooperation, promote commercialization of research results and create momentum for national innovation.

To clarify the above issue, Tin Tuc and Dan Toc newspaper reporter had an interview with Mr. Le Van Cham, Director of the Institute for Research and Application of New Technology on this topic.

How do you evaluate Article 37 of the Law on Science , Technology and Innovation in creating conditions for non-public units to participate in science, technology and innovation activities?

Article 37 of the Law on Science, Technology and Innovation, which was recently passed by the National Assembly in its last session, stipulates: Ensuring rights and support mechanisms for non-public organizations in scientific, technological and innovative activities; in which, item a, clause 2 clearly states: Non-public organizations have the right to participate in selection, recruitment, ordering or bidding to perform scientific, technological and innovative tasks using the State budget.

It can be seen that Article 37 is an important step forward in affirming the position and role of non-public organizations in the ecosystem of science, technology and innovation. The biggest strength of this provision is to create a mechanism of equal access between public and non-public organizations. Non-public institutes have the right to participate in bidding, receive orders for science and technology tasks from the state budget, access facilities, enjoy preferential policies on tax, land, credit, etc. like public units. This is the legal foundation for us to develop research capacity, commercialize scientific results, and promote public-private cooperation in an open and transparent manner.

However, the weak point is that the enforcement mechanism is still far from the regulations. Many non-public institutes in reality still have difficulty accessing programs and projects using the budget; administrative procedures are still complicated; the mechanism for renting and using public infrastructure is unclear and slow to implement. In addition, ensuring intellectual property rights and sharing benefits in public-private partnerships requires more detailed guidance to avoid risks and inequality.

In fact, when participating in bidding for scientific tasks using the state budget, non-public institutes often face disadvantages due to lack of early information, lack of relationship network, and difficulty in meeting the conditions of capacity profile and facilities according to the criteria of "priority" for public units. This makes the right to equality recognized in the law not fully promoted.

Thus, Article 37 is a progressive legal basis, but to truly promote its effectiveness, there needs to be specific policies, simpler and more transparent procedures, especially in bidding and resource allocation, to help non-public research institutes promote their potential and contribute more to national innovation.

So, for the Law to be put into practice, there needs to be specific guidance. What is your opinion on this issue?

Technology enterprises and non-public research institutes have highly intelligent human resources and are well-invested, but have difficulty accessing state capital, state projects, and public investment.

Therefore, we also wish for equality, credit mechanisms, access to credit packages approved by the Government for scientific and technological research with optimal interest rates; and at the same time, applying scientific research topics to life.

In the coming time, will your unit participate in any new scientific and technological research projects in life, sir?

To support the national innovation program in science and technology, our Institute has invested in human resources and modern equipment. We focus on attracting scientists and human resources specializing in AI core technology research, who have studied and worked at government agencies in Japan, New Zealand, and Canada.
