Unify a civil service system from the central to the communal level

BBK - The Law on Cadres and Civil Servants (amended) is an important step to concretize the Party's major policies and orientations on cadre work and civil service regime into practice effectively, contributing to building a modern, professional Vietnamese civil service, operating for the country's development and serving the people.

Contribute to building a professional administration

On the morning of May 7, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly continued its working session in the Hall, listening to the Presentation and Report on the review of the draft Law on Cadres and Civil Servants (amended).

Presenting the Draft Law on Cadres and Civil Servants (amended), Minister of Home Affairs Pham Thi Thanh Tra said that the amendment of the current Law on Cadres and Civil Servants aims to implement the Party's policy on organizing a two-level local government model, associated with the requirements of streamlining the payroll, restructuring and improving the quality of cadres and civil servants.

Thereby, contributing to building a professional administration, innovating national governance towards modernity, efficiency, effectiveness, and efficiency, focusing on development management to bring the country into a new era.

The Draft Law consists of 7 Chapters and 52 Articles (35 articles less than the current law) with basic contents such as perfecting regulations to implement the policy of building a unified, interconnected, and synchronous civil service from the central to communal levels.

At the same time, transitional regulations are in place for commune-level cadres and civil servants elected or recruited before the effective date of this law; if they meet sufficient standards and conditions, they will be converted into cadres and civil servants according to the provisions of this law.

The draft clearly stipulates that the evaluation, arrangement, and use of cadres and civil servants must be based on the requirements of the job position and the capacity and performance results of the cadres and civil servants; the regulation on exams for promotion is eliminated, and instead, the mechanism is to assign each job position to the corresponding civil servant rank.

Innovate the recruitment of civil servants in the direction that the selected person must immediately meet the requirements of the job position, and after being selected, he/she will be appointed and have his/her salary ranked in the corresponding civil servant rank. Eliminate the regulation on the unified quality assessment of civil servant input at the national level to implement the policy of strong decentralization and delegation of authority in civil servant management.

The draft law also stipulates that civil servants must be evaluated based on specific results and work products according to the requirements of the job position, instead of based on general, formal or emotional criteria. At the same time, it clearly stipulates the responsibility of the head in using and evaluating civil servants according to their capacity and job position...

The Minister of Home Affairs stated that the Law on Cadres and Civil Servants (amended) is an important step to concretize the Party's major policies and orientations on cadre work and civil service regime into practice effectively, contributing to building a modern, professional Vietnamese civil service that operates for the country's development and serves the people.

Combining job title standards, job positions and staffing targets

The review report presented by Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung stated that the Committee agreed with the comprehensive amendment of the Law on Cadres and Civil Servants; stating that the provisions of the draft law closely followed the Party's policy on arranging and streamlining the apparatus and organization of two-level local governments in conjunction with restructuring and improving the quality of cadres and civil servants; implementing interconnectivity in cadre work, unifying a civil service regime from the central to the commune level; and at the same time overcoming shortcomings, limitations and obstacles in the implementation of the law in the past.

The Committee also basically agreed to continue to stipulate the principle of managing cadres and civil servants as "a combination of title standards, job positions and staffing quotas".

Along with that, perfecting regulations on job positions and civil servant ranks as a basis for continuing to innovate the management of cadres and civil servants; amending regulations on civil servant evaluation to have a screening mechanism based on results, specific products and handling cases of failure to complete tasks.

These regulations have, on the one hand, basically met the requirements for innovation in the management and use of cadres and civil servants in the spirit of Conclusion No. 121-KL/TW dated January 24, 2025 of the Party Central Committee.

On the other hand, it contributes to ensuring the stability of the staff and civil servants in the context of implementing the organizational arrangement of agencies, organizations and units in the political system.

The Committee agreed to remove the regulation on quality control of civil servant input to implement the Party's new policy in Conclusion No. 121-KL/TW.

At the same time, agree to stipulate a number of principled issues on the basis for determining, content and classifying civil servant job positions; assign the Government to stipulate principles, order and procedures for developing and approving job positions to ensure flexibility and meet state management requirements in each period./.
