Through the Law on People's Air Defense

(TN&MT) - On the morning of November 27, under the direction of Vice Chairman of the National Assembly , Senior Lieutenant General Tran Quang Phuong, the National Assembly voted to pass the Law on People's Air Defense, with 449/449 National Assembly deputies participating in the vote in favor, accounting for 93.74% of the total number of National Assembly deputies.

Unmanned aircraft must be registered before being put into operation and use.

The Law on People's Air Defense consists of 7 Chapters and 47 Articles, regulating principles, tasks, forces, and activities of people's air defense; management of unmanned aircraft and other flying vehicles and ensuring air defense safety; resources, regimes, policies, rights, obligations, and responsibilities of agencies, organizations, enterprises, and individuals regarding people's air defense.

Regarding the people's air defense tasks, including: Training, combat readiness, combat, prevention and combat against enemy intrusions and air attacks and participating in the management and protection of airspace at altitudes below 5,000 meters. Implementing measures to ensure the safety of life and property of agencies, organizations, businesses and individuals. Serving combat, overcoming the consequences of enemy intrusions and air attacks. Performing other tasks as prescribed by law.

Prohibited acts include avoiding, opposing, obstructing the construction, mobilization, operation and implementation of responsibilities to participate in the people's air defense force as prescribed in this Law. Mobilizing and using forces, weapons, means and works of the people's air defense against the provisions of law. Taking advantage of and abusing the performance of people's air defense tasks to violate the law, infringe upon the interests of the State, the rights and legitimate interests of agencies, organizations, enterprises and individuals. Providing information, informing, filming, taking photos, measuring and drawing to reveal battlefield targets, plans, technical equipment and combat works. Gender discrimination in the performance of people's air defense work. Manufacturing, testing, producing, repairing, maintaining, trading, importing, exporting, temporarily importing for re-exporting, temporarily exporting for re-importing, owning, exploiting, using unmanned aircraft, other flying vehicles, aircraft engines, aircraft propellers and equipment, devices of unmanned aircraft, other flying vehicles illegally...

The law also stipulates that unmanned aircraft and other flying vehicles must be registered before being put into operation and use. At the same time, the registration conditions must meet the standards and technical regulations issued or recognized by the Ministry of National Defense ; there must be a certificate of technical standards from the manufacturer for goods manufactured in Vietnam. Imported unmanned aircraft and other flying vehicles must have full valid documents according to the provisions of law when imported into Vietnam.

Maintain the management scope at an altitude below 5,000m

Previously, presenting the Report on explanation, acceptance and revision of the draft Law on People's Air Defense, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the task of people's air defense (Article 5), in Clause 1, there was an opinion suggesting to add regulations on the management range of over 5,000m to ensure security, order and national defense in the locality; another opinion suggested to regulate people's air defense at an altitude of under 3,000m because the weapons equipped for the people's air defense force cannot destroy targets at an altitude of over 5,000m.

Chairman of the National Defense and Security Committee Le Tan Toi presented a report explaining, accepting and revising the draft Law on People's Air Defense.

The National Assembly Standing Committee believes that the draft Law stipulates that the people's air defense force participates in managing and protecting the airspace at an altitude of less than 5,000m based on the tasks, weapons, equipment, combat capabilities of the people's air defense force and the coordination relationship with other forces in combat readiness, combat, prevention and control of enemy air attacks. Currently, the people's air defense force has been equipped with weapons with a range of over 5,000m; equipped with air defense reconnaissance means capable of observing and detecting targets at an altitude of less than 5,000m. Therefore, the people's air defense force is capable of participating in managing and protecting the airspace at an altitude of less than 5,000m. Therefore, it is proposed that the National Assembly keep the regulation on the management scope at an altitude of less than 5,000m.

Regarding the people's air defense command agency (Article 9), there is a suggestion to add clause 2 to point b clause 1 and revise it as: "The Ministry of National Defense assists the Government in directing air defense as the standing agency of the Central People's Air Defense Command; military agencies at all levels are the standing agencies of the same-level people's air defense command agency in the locality".

The Standing Committee of the National Assembly stated that the provisions in the draft Law ensure the separation between the Steering Agency and the Standing Agency advising and assisting the People's Air Defense Steering Committee at all levels; in accordance with Decree No. 74/2015/ND-CP and without any problems. At the same time, to ensure more clarity, the Standing Committee of the National Assembly added Clause 2 to stipulate: "The People's Air Defense Steering Committee is organized at the central, military region and local levels. The People's Air Defense Steering Committee at all levels has the task of advising and assisting the People's Air Defense Steering Committee at the corresponding level".
