Prime Minister Pham Minh Chinh has just signed and issued Official Dispatch No. 365/CD-TTg directing the urgent review and timely handling of recommendations and proposals from localities, ministries and branches, to improve the effectiveness and efficiency of direction and administration.

The dispatch stated that, in the past time, based on the Law on Organization of the Government, the Law on Organization of Local Government and the Working Regulations of the Government, ministries, ministerial-level agencies, agencies under the Government (collectively referred to as ministries and agencies) and localities have strengthened working relations, coordinated to resolve or submitted to competent authorities to resolve many important issues, contributing to promptly removing difficulties and obstacles for people and businesses, contributing to the socio -economic development of localities and the whole country. However, in reality, there are still many recommendations and proposals from localities sent to ministries and agencies that have not been resolved, responded to, or guided in a timely manner. In some cases, the responses and guidance are very slow, causing a long backlog; in some cases, the responses and guidance are general, evasive, unclear in viewpoint, and not on the issues that need to be resolved. The coordination between a number of ministries and agencies to resolve recommendations and proposals from localities is often not close and timely; Some presiding agencies have abused the consultation and coordination to avoid the responsibilities of their ministries and agencies... To overcome the above shortcomings and limitations, improve efficiency, promptly handle work, and make practical contributions to the socio-economic development of localities and the whole country, the Prime Minister requests ministries, agencies, and localities to thoroughly grasp and strictly implement the Government's Working Regulations issued together with Decree No. 39/2022/ND-CP dated June 18, 2022; continue to rectify and enhance responsibility in handling work according to the direction of the Prime Minister in Official Dispatch No. 280/CD-TTg dated April 19, 2023, strengthen working relations, and closely coordinate between Ministers, Heads of ministerial-level agencies, Heads of Government agencies and local authorities in handling work. Immediately resolve outstanding issues that have not been resolved overdue. In particular, the Prime Minister requested Ministers, Heads of ministerial-level agencies, Heads of Government agencies to uphold the responsibility of the head, at the same time promote the responsibility of leaders of ministries, agencies, units and cadres and civil servants in resolving recommendations and proposals of localities, ministries and branches and must identify this as a key task that needs to be resolved promptly and thoroughly in order to actively contribute to the implementation of socio-economic development tasks of localities, ministries and branches, serving the interests of the people and the country. In addition, focus on and urgently review recommendations and proposals of provincial People's Committees, ministries and branches that have been sent to ministries and agencies and be responsible for resolving them within their authority and within the time limit prescribed in Clause 1, Article 11 of the Government's Working Regulations, especially promptly resolving outstanding issues that have not been resolved overdue, not allowing further delays or prolongation. In case the issue is under the jurisdiction of the locality, ministry or branch, the ministries or agencies receiving the recommendation or proposal must immediately return it in writing, stating the reasons and grounds for not considering or resolving it, and not being within their jurisdiction; and at the same time, provide appropriate guidance (if necessary). Do not shirk or avoid responsibility . For recommendations and proposals from localities, ministries or branches, it is necessary to seek opinions from relevant ministries or agencies. Upon receiving recommendations and proposals from localities, ministries or branches, the ministries or agencies in charge must immediately send a document to relevant ministries or agencies for comments, clearly stating the issue of comments and the deadline for response. Absolutely do not seek coordination opinions from unrelated ministries or agencies. During the process of collecting opinions, the ministries or agencies in charge must proactively and actively coordinate, urge and exchange directly so that the coordinating ministries or agencies can respond promptly and on time. After receiving the opinions of the coordinating ministries or agencies; The ministries and agencies in charge are responsible for reviewing and deciding according to their authority or providing written responses and instructions immediately, clearly and decisively, without shirking or avoiding responsibility. In case the ministries and agencies consulted do not respond or are slow to respond after the deadline, they shall be handled in accordance with the provisions of the Government's Working Regulations and the Prime Minister's direction at Point c, Clause 1, Official Dispatch No. 280/CD-TTg. In addition, regularly monitor and urge the settlement of recommendations and proposals from localities, ministries and branches to ensure that no work is missed or delayed.
Not submitting work within the local authority to the Government and the Prime Minister The Prime Minister also requested the Chairmen of the People's Committees of provinces and centrally run cities to proactively and actively perform their duties and powers; be responsible for deciding on issues within their authority or being authorized according to the provisions of law; not submit or report work within their authority to the Government, the Prime Minister and ministries, branches and central agencies in accordance with the Prime Minister's direction in Official Dispatch No. 280/CD-TTg. The Chairmen of the People's Committees of provinces and centrally run cities shall review the local documents that have been sent to ministries, branches and central agencies but have not been resolved; synthesize and report to the Prime Minister; and at the same time actively and proactively coordinate, exchange and regularly urge. If necessary, the Chairman of the Provincial People's Committee shall request to work with the Minister and Head of the agency to promptly handle the recommendations and proposals of the locality in accordance with the provisions of Clause 4, Article 11 of the Government's Working Regulations. The Prime Minister requests the Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of the People's Committees of provinces and centrally run cities to thoroughly grasp and strictly implement the tasks assigned in this Official Dispatch; report to the Prime Minister and Deputy Prime Minister in charge before May 15, 2023 on the recommendations of localities, ministries and branches that have not been considered and resolved by the ministries and agencies for timely direction and urging for resolution according to their authority and provisions of law. The Government Office shall proactively and regularly monitor, urge and inspect the ministries and agencies in performing the tasks assigned by the Government and the Prime Minister related to the locality. Based on reports from ministries, agencies and localities, every month, the Government Office reports to the Prime Minister and Deputy Prime Minister the results of handling recommendations and proposals from ministries, branches and localities and takes timely measures to direct and urge, contributing to improving the effectiveness and efficiency of direction and administration.
