On the afternoon of May 23, continuing the program of the 9th session of the 15th National Assembly , the National Assembly discussed the draft Law amending and supplementing a number of articles of the Law on Bidding; Law on Investment under the public-private partnership model; Law on Customs; Law on Export Tax and Import Tax; Law on Investment; Law on Public Investment; Law on Management and Use of Public Assets (draft Law amending and supplementing 7 laws).
Agreeing with the draft Law, delegate Luu Ba Mac - National Assembly Delegation of Lang Son province proposed additional opinions related to the content of amending the Law on Bidding to remove practical difficulties in bidding for organizing cultural, sports and tourism events.

According to the delegate, Clause 11, Article 1 of the draft Law amending and supplementing 7 laws has amended Article 23 of the Law on Bidding on bid designation in the direction of not specifying in detail the cases of bid designation but stipulating the requirements for bid packages under the procurement estimate project, and at the same time decentralizing to the Government to specify in detail the cases of bid designation.
Considering that the conditions and procedures for implementing the bidding and the reasons for this amendment have been explained and justified very reasonably, creating flexibility and suitability with the current practical situation, delegate Luu Ba Mac proposed to add regulations on the designation of bidding packages related to the organization of cultural, sports and tourism events.
Specifically, the delegate proposed that the drafting agency consider adding a provision to Clause 11, Article 1 of the draft Law amending and supplementing 7 laws, or consider adding it when drafting a decree detailing Clause 11, Article 11 of the draft Law amending and supplementing 7 laws (ie amending Clause 1, Article 23 of the Law on Bidding).
According to the delegate, the reason for this proposal is that in reality, cultural, sports and tourism events are very specific in nature and each event is a product bearing the unique creative imprint of each unit and individual associated with the spatial and temporal context as well as the cultural characteristics of each locality; each program requires careful survey, idea building from the beginning, with continuity from the overall scenario to each item for implementation.
If bidding is organized widely as it is now for normal technical bid packages, it will be very difficult to have a set of criteria that are objective enough to evaluate, classify and award bids based on the above specific characteristics.
Furthermore, the time to carry out the steps in the bidding process is often long, while the requirements for event organization progress are often fast, urgent, high quality, attractive, creative and on-schedule programs, all of which require careful and elaborate preparation.
Not to mention, if the winning bidder is not in tune or sympathetic with the original draft of the art program's script that has been approved by the local authority, the continuity, quality and effectiveness of the art program, its appeal and creativity will also be seriously affected. This has happened in some places and at some times in practice and has had a significant impact on the locality where the event was held and the localities related to the program held in that locality.
"Therefore, we respectfully request that the drafting agency consider and study additional regulations on the appointment of contractors for special bidding packages such as organizing cultural, sports and tourism events of appropriate scale, ensuring efficiency, saving time, improving the quality of artistic products, creative communications and especially creating favorable conditions for localities to implement in practice," delegate Luu Ba Mac suggested.
Minister Nguyen Van Thang, on behalf of the drafting agency, made a statement explaining and clarifying the issues raised by the National Assembly delegates.
On behalf of the drafting agency, Minister of Finance Nguyen Van Thang explained and clarified the issues raised by National Assembly deputies, saying that regarding the content related to the proposal to supplement the appointment of contractors for special bidding packages such as organizing cultural and tourism events, increasing the limit of appointment of contractors or adding responsibilities and decision-making authority, the drafting agency will accept it.
The detailed decree will supplement these cases and clearly define the responsibility and authority for decision. At the same time, the draft Law has also added a mechanism for bidding designation requiring price negotiation to ensure the highest economic efficiency for investors during the bidding process.
