On the afternoon of May 17, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Bidding; the Law on Investment under the public-private partnership model; the Law on Customs; the Law on Export Tax and Import Tax; the Law on Investment; the Law on Public Investment; and the Law on Management and Use of Public Assets.

General Secretary To Lam pointed out: "The current Law on Bidding is carrying within it "four very serious crimes" - "crimes" that are not only technical legislative errors but also practical consequences that deeply affect the country's development.
That is: slowing down the progress of internal development; leading to poor quality products and projects; wasting resources and damaging and losing cadres". Frankly pointing out the situation for many years "having money but not being able to spend it all, while the country is in dire need of development, having to borrow from foreign countries"; patients not having access to good medicine, modern medical technology being hindered by bidding; machinery and medicine having to be bought from outside, carried by hand, creating conditions for smuggling and counterfeit medicine.

The General Secretary also mentioned the lack of flexibility in public investment and public-private partnership (PPP) - which is a global trend and very necessary for Vietnam. However, the current mechanism makes it a formality. The State has money, localities have demand, but cannot coordinate to do a common project. Obviously, the current institution and the implementation process have not created conditions for diverse cooperation models such as BOT, BT, leading to a "dead" policy situation.
Therefore, General Secretary To Lam said that amending the Law on Bidding and related laws is an urgent requirement to remove the weak points in public investment disbursement and public-private partnership, avoiding waste of resources. However, according to the General Secretary, to amend the Law on Bidding, it is necessary to summarize what bidding has caused.
The General Secretary affirmed that the amendment of the law is not a movement or a theory, but comes from practical requirements. Law making is to serve the cause of national renewal, not to serve group or local interests. To successfully carry out the revolution of streamlining the apparatus and developing a sustainable economy, it is necessary to comprehensively review the legal system, in which the Law on Bidding is one of the major bottlenecks that need to be promptly removed to unblock resources, quickly disburse public investment, transparent public-private partnership, and especially how to prevent negativity in bidding.
