Ho Chi Minh City issues guidelines on paying overtime wages for teachers who teach two sessions per day.

GD&TĐ - The Ho Chi Minh City Department of Education and Training has just issued guidelines for preparing budget estimates for overtime pay for teachers participating in teaching two sessions per day.

According to the Ho Chi Minh City Department of Education and Training, the teaching load for general education teachers is as follows: Primary school teachers: 23 lessons/week; Secondary school teachers: 19 lessons/week; High school teachers: 17 lessons/week. This load serves as the basis for determining the standard teaching hours of each teacher during the school year.

Overtime pay applies to teachers who have completed the teaching load according to Circular 05/2025/TT-BGDĐT and participate in teaching two sessions per day as officially assigned.

Overtime pay is determined based on the timetable, teaching assignment schedule, and related supporting documents, and is approved by the head of the unit.

The school must ensure that teachers fulfill their average weekly teaching load; this must be specifically detailed in the teaching assignment schedule, educational activities, and timetable, serving as the basis for determining any teaching hours exceeding the load (if any).

This serves as the basis for determining the number of teaching hours exceeding the standard for each teacher and the entire school during a semester or school year, facilitating the preparation of payment estimates.

The Ho Chi Minh City Department of Education and Training has instructed the heads of general education institutions to: Arrange appropriate timetables; Review the qualifications of the teaching staff and facilities to ensure teaching is possible for two sessions per day; and Assign teaching duties reasonably and fairly among teachers.

Overtime pay is calculated according to Circular 21/2025/TT-BGDĐT. Accordingly: Each teaching hour exceeding the standard rate is paid at 150% of the salary for a standard teaching hour; teachers are only paid a maximum of 200 overtime teaching hours per school year.

In exceptional cases due to teacher shortages, where the number of extra teaching hours exceeds 200 hours per year, educational institutions must report to their superior authority for consideration and follow the procedures outlined in Article 62 of Decree 145/2020/ND-CP. Extra teaching hours must be voluntary and agreed upon by the teachers.

The budgeting and settlement of overtime pay for teaching hours shall be carried out in accordance with the State Budget Law and current financial guidelines. The payment budget is based on the approved plan for teaching and educational activities in the second session from the 2025-2026 school year.

Funding source: The funds for paying overtime teaching salaries are allocated from the public service unit's financial resources within its annual budget.

Socialization funding: For the second session activities conducted through socialization, the unit may use service fees collected to support educational activities as regulated, to pay teachers based on mutual agreement.

Schools may pay or advance overtime pay on a monthly, semester, or annual basis, depending on the actual circumstances and agreement with the teacher.

The Ho Chi Minh City Department of Education and Training announced that, starting from the second semester of the 2025-2026 school year, this expenditure will be included in the budget estimate from the beginning of the year, as per regulations.

Specifically for 2025, due to new developments arising from the Prime Minister's directive in Directive 17/CT-TTg dated June 6, 2025, and the Ministry of Finance 's Official Letter 9179/BTC-NSNN, in cases where the expenditure exceeds the 2025 budget allocation, units will be considered for supplementary budget allocation as prescribed.

Units under the Ho Chi Minh City Department of Education and Training must review the actual needs arising in the first semester of the 2025-2026 school year and submit them to the Department before December 25, 2025, for assessment and budget allocation. If the needs exceed the allocated budget, the Ho Chi Minh City Department of Education and Training will report to the Department of Finance for submission to the City People's Committee for consideration and decision.

For educational institutions under the management of the People's Committee of wards, communes, and special zones, the review of needs and proposals for additional funding shall be carried out according to the decentralized management system; in cases exceeding the available budget, the People's Committee at the local level is responsible for reporting to the Department of Finance for submission to the City People's Committee for decision.
