According to the resolution, the Director of the Department of Education and Training has the authority to recruit and appoint teachers, educational administrators, and staff in public educational institutions within the province.

In addition, it is authorized to assign, transfer, second, appoint, and change job positions for teachers, educational administrators, and staff in public educational institutions under its management authority, as well as public educational institutions related to two or more commune-level administrative units within the province.

During the drafting process, alongside opinions supporting the proposal, some expressed concerns about the feasibility of granting the director of the Department of Education and Training the full authority to recruit all local education personnel.

This is because the number of schools in a province is very large, the geographical area is vast, while the staff of the education department is small. Not to mention that centralized examinations can cause difficulties and inconvenience for candidates in terms of travel and participation in the exams...

Some have suggested that the authority to recruit personnel for public educational institutions under their direct management and to transfer, reassign, and second teachers and educational administrators between two commune-level administrative units within the same province should only be delegated to the director of the Department of Education and Training.

In explaining the above content, the Government stated that the Department of Education and Training is the specialized agency for education and training, annually taking the lead in conducting many major examinations of the sector throughout the province. The department's workforce, as well as experts including experienced administrators and teachers, can be mobilized to conduct the examination, fully meeting the requirements of a large-scale recruitment process.

For example, the Ho Chi Minh City Department of Education and Training completed the teacher recruitment process citywide from October to November 2025 after the merger, with the number of eligible candidates reaching 10,000.

The Ministry of Education and Training is drafting a circular regulating the authority to recruit teachers. Based on feedback, all 31 localities that provided input agreed to entrust the Department of Education and Training with the recruitment of teachers in high schools, continuing education, and special education institutions. 27 localities agreed to entrust the Department with the recruitment of teachers in preschool, primary, and lower secondary education institutions.

The resolution also grants the commune chairman the authority to deploy teachers within their administrative jurisdiction.

The resolution also stipulates that the chairman of the People's Committee at the commune level has the authority to transfer, reassign, second, appoint, dismiss, and change job positions for teachers, educational administrators, and staff in public educational institutions under their management.

When commenting on the draft, some opinions expressed concern that decentralizing power and authority to the chairpersons of commune-level People's Committees as described above would make it difficult to ensure close coordination with professional management.

The government stated that the Law on Organization of Local Government and current regulations on decentralization of authority have granted the chairman of the People's Committee at the commune level the authority to manage tasks related to preschool and lower secondary education.

Therefore, the resolution authorizing the chairperson of the People's Committee at the commune level to deploy and transfer personnel in the education sector within their management authority will ensure flexibility and appropriateness in management work in the area; at the same time, it must ensure the selection of the right personnel for the right job positions according to job position standards.

The government also affirmed that the recruitment of education personnel within the province will be carried out according to plan based on reviews and proposals from communes and wards; the Director of the Department of Education and Training will allocate personnel to communes to ensure uniformity and avoid localized teacher shortages or surpluses.
