According to the Draft Law on Cyber Security, fully aware of the importance of cyberspace, the Party and State have recently issued many policies and orientations related to perfecting the institution on cyber security. Therefore, the promulgation of the Law is necessary.

Vice Chairmen of the National Defense, Security and Foreign Affairs Committee Nguyen Hai Hung, Nguyen Minh Duc, and Nguyen Quoc Hung attended the meeting.

The draft Law is expected to regulate activities to protect national security, ensure social order and safety, and protect the legitimate rights and interests of agencies, organizations and individuals in cyberspace; ensure information security and information system safety; and responsibilities of relevant agencies, organizations and individuals.

The Draft Law inherits 30 articles of the 2018 Law on Cyber Security (of which 21 articles remain unchanged, 9 articles are amended and supplemented), inherits 16 articles of the 2015 Law on Network Information Security (amended and supplemented in 2018), of which 12 articles remain unchanged, 4 articles are amended and supplemented; consolidates the contents of 9 articles of the 2 above-mentioned laws; and supplements 3 articles.

The Draft Law has a number of new and amended contents. Specifically, it adds 1 article regulating data security; 1 clause in the article regulating the responsibilities of enterprises providing services in cyberspace; adds regulations on encouraging agencies and organizations in the political system and state-owned enterprises to use Vietnam's security industry products and services that ensure quality standards and regulations to improve autonomy in cybersecurity...

The majority of delegates agreed on the necessity of promulgating the Law on Cyber Security to thoroughly grasp and promptly institutionalize the Party's guidelines, policies, and guiding viewpoints on protecting the Fatherland; protecting cyber security; innovating and streamlining the political system's apparatus to operate efficiently, effectively, and effectively; developing science , technology, innovation, and national digital transformation; and innovating the work of building and enforcing laws to meet the requirements of national development in the new era.

Delegates said that the promulgation of the Law on Cyber Security aims to create consistency with recently issued legal documents; to meet the urgent needs of the practical situation of protecting, preventing and stopping cyber attacks, protecting national and ethnic interests, and protecting the rights and legitimate interests of individuals and organizations.

At the same time, it is necessary to clarify that the contents of the draft Basic Law are consistent with the orientation and key tasks of ensuring social security, human security, economic security, and cyber security as affirmed in the Resolution of the 13th National Party Congress; and are compatible with relevant international treaties to which Vietnam is a member.

However, there are opinions that currently, the content of cyber security is being regulated in many different specialized legal documents. Therefore, it is recommended that the drafting agency continue to research and carefully review relevant legal documents to complete this draft Law to ensure consistency, and not to re-regulate in the Law general contents or those already regulated in related Laws.

Some opinions agreed with the content on preventing and handling acts of cyber security violations (Chapter III); stating that this is one of the key contents of the draft Law, demonstrating progress compared to the provisions of the current Law on Cyber Security and Law on Network Information Security, consistent with the context of information technology development, digital transformation, increasing cyber attacks, cybercrime, and violations of the law in cyberspace.

Suggestions suggest that it is necessary to add protection objects to vulnerable people such as the elderly, people with lost or limited civil capacity; add regulations to prevent, stop and promptly handle acts of using "AI deepfake" technology to edit and create clips, images and sounds to fake the identity and identifying characteristics of famous people or relatives to defraud, defame, and provide false information...

Concluding the meeting, on behalf of the review body, Vice Chairman of the National Defense, Security and Foreign Affairs Committee Nguyen Minh Duc respectfully thanked the delegates for their comments on the contents of the draft law. At the same time, he requested that the Drafting Committee take into account the comments to continue perfecting the contents of the draft law; closely coordinate with the Standing Committee to promptly complete the documents and review reports on the draft law, ensuring quality when submitting it to the National Assembly at the upcoming 10th Session.
