Briefly presenting the Draft Law, Minister of Finance Nguyen Van Thang said that, in the face of changes in the socio-economic situation, legal documents on investment, finance and budget have encountered some difficulties and problems in the implementation process, so they need to be reviewed and studied for amendment and supplementation.
Accordingly, the Government has urgently reviewed, summarized, and evaluated the implementation of Laws in the fields of investment, finance, and budget and identified 7 Laws that need to be amended and supplemented appropriately to implement the arrangement and organization of the local government apparatus, creating momentum to contribute to promoting the development of science, technology, innovation, national digital transformation, and promoting economic growth...

The Minister stated that the drafting of the Law aims to fully institutionalize the policies and orientations of the Party and State on the development of science, technology, innovation, and digital transformation; reorganize the state apparatus; promote support, decentralization, delegation of power, and reform of administrative procedures on investment, finance, and budget. Timely remove difficulties and obstacles, clear up and effectively use resources for economic development, science, technology, innovation, and national digital transformation. Ensure the unity and synchronization of the legal system; improve the investment and business environment; and promote economic growth.
Regarding the scope of regulation, the draft Law amends and supplements a number of articles of 7 current Laws, including: Law on Bidding; Law on Investment under the public-private partnership model; Law on Customs; Law on Export Tax and Import Tax; Law on Investment; Law on Public Investment; Law on Management and Use of Public Assets.

In particular, regarding the content of amending and supplementing a number of articles of the Law on Bidding, the draft Law amends the provisions on: Priority and preferential policies in bidding to support the development of science and technology, innovation, digital transformation; bidding activities of state-owned enterprises and public service units; supplementing provisions on domestic bidding, international bidding; principles allowing investors and competent persons to base on the scale, nature, and actual conditions of the bidding package to choose to apply appropriate forms of contractor selection (bidding, designated bidding or other forms as prescribed by law) on the basis of ensuring transparency, economic efficiency and accountability.

At the same time, supplement and expand the cases of applying the form of bidding and selecting contractors and investors in special cases for bidding packages and projects that need to ensure national interests or have special requirements for research, application and development of science and technology...
Regarding the content of amending and supplementing a number of articles of the Law on Management and Use of Public Assets, the draft Law amends regulations related to the management and use of assets formed through the implementation of scientific and technological tasks; abolishes regulations on the management and use of assets formed through the implementation of scientific and technological tasks using state capital; abolishes a number of phrases to ensure consistency and unity with the content and scope of the Law; amends the contents on the arrangement and organization of the apparatus, promoting decentralization and delegation of power, etc.

Need for additional policy impact assessment
Briefly presenting the Report on the review of the draft Law, Permanent Deputy Chairman of the Economic and Financial Committee Le Quang Manh said that the Committee basically agreed on the necessity and scope of amending and supplementing the laws according to the Government's Submission. The draft Law basically meets the requirements of the Law on Promulgation of Legal Documents for the simplified procedure.
However, the time to send the Law File to the agency in charge of the review is very urgent, some new policy contents are adjusted and supplemented after the Ministry of Justice has appraised, the Committee requests the Government to report and explain and supplement the policy impact assessment so that the National Assembly Standing Committee and the National Assembly have a basis for consideration and decision.

Regarding the constitutionality, legality, and consistency of the draft Law, with the legal system and the implementation of conclusions and regulations of competent authorities, the Standing Deputy Chairman of the Economic and Financial Committee stated that, along with the amendment of the Constitution, the Law on Organization of Local Government and many related draft Laws will be submitted to the National Assembly for consideration and approval at the upcoming Ninth Session. Therefore, the process of studying and receiving the draft Law needs to be reviewed and compared with the provisions of the Constitution and the Laws being amended and supplemented to ensure consistency. In addition, it is recommended that the Government review the entire content of the draft Law to ensure proper implementation of the direction in Conclusion No. 119-KL/TW, Regulation No. 178-QD/TW and Regulation No. 189-QD/TW of the Politburo.

Regarding specific contents, Standing Deputy Chairman of the Committee Le Quang Manh said that the Committee basically agrees with the revised contents related to the institutionalization of Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation; at the same time, it noted that the drafting agency continues to closely coordinate with relevant ministries and agencies to review and ensure consistency between relevant laws, new terms on science and technology... and transitional provisions to ensure consistency.
