Accordingly, implementing the direction of the Provincial People's Committee and the functional agencies of the former Quang Binh province, in July 2023, the People's Committee of the former Bo Trach district, through checking the dossier of granting land use right certificates, verified the content of Mr. Duong Viet Vuong's complaint, showing that: Mr. Vuong was granted a land use right certificate by the People's Committee of Bo Trach district, house ownership rights and other assets attached to land at plot No. 656, cadastral map sheet No. 07, Hoa Trach commune with an area of 412.5m2 on July 26, 2011, originating from the State's allocation of land through land use right auction.
Implementing the project to complete the land records and land database in Hoa Trach commune, land plot No. 656, cadastral map sheet No. 07, Hoa Trach commune, area 412.5m2 was re-measured to become land plot No. 580, cadastral map sheet No. 07, area 401.8m2 , and was granted a land use right certificate, house ownership rights and other assets attached to the land on September 10, 2014. However, after re-checking, it was discovered that the issued land use right certificate had an error in area, so the Branch of Bo Trach District Land Registration Office punched holes to cancel and stored the canceled land use right certificate.
In 2017, Mr. Vuong submitted a request to issue, reissue the Certificate of Land Use Rights, house ownership rights and other assets attached to land for land plot No. 656, cadastral map No. 07, Hoa Trach commune and on May 22, 2017, the People's Committee of Bo Trach district issued a change to land plot No. 580, map No. 07, Hoa Trach commune with an area of 412.5m2 .
However, according to the results of the current land use measurement of the Bo Trach District Land Registration Office Branch on August 16, 2023, the actual area that Mr. Vuong is using is only 387m2 , a decrease of 34.5m2 compared to the area of the granted land use right certificate.
Comparing the results of the actual measurement and the results of the examination of the detailed planning drawing of land plot No. 656, map sheet No. 07 shows that the process of making the detailed planning drawing approved by the People's Committee of Bo Trach district in 2011 had errors in the area of the land plot, leading to errors in putting the land area up for auction and granting the land use right certificate to Mr. Vuong.
After discovering the above error, the People's Committee of Bo Trach district affirmed: The land use right certificate, house ownership right and other assets attached to the land that Mr. Vuong said had a forged signature were canceled and stored at the Branch of the Bo Trach District Land Registration Office.
"From July 1, 2025, the district-level government will cease to operate. According to the provisions of Decree No. 141/2025/ND-CP, effective from July 1, 2025, on the division of authority between two levels of local government in the field of state management of the Government Inspectorate , the authority to resolve Mr. Duong Viet Vuong's complaint will fall under the authority of the Chairman of the Provincial People's Committee," said Mr. Nguyen Van Uoc, Deputy Chief Inspector of the province. |
To overcome this consequence, the People's Committee of Bo Trach district proposed two solutions. First, refund the land use fee corresponding to the missing land area, plus the annual bank interest rate. Second, hand over another land plot in Hoa Trach commune with a location equivalent to the value of the land plot that was previously auctioned and had been granted a land use right certificate. However, Mr. Vuong did not agree with the two solutions above of the People's Committee of Bo Trach district.
According to Mr. Duong Viet Vuong, although the People's Committee of Bo Trach district admitted to making mistakes in auctioning the land area and granting him a land use right certificate with insufficient area; violations in granting him a land use right certificate in 2014 leading to its revocation and cancellation, it still did not accept his complaint regarding the content: Bo Trach district People's Committee officials forged his signature in the process of preparing the dossier to reissue the land use right certificate in 2014, which was not true to reality, causing damage to him as a citizen when his land area was reduced to 34.5 square meters compared to the area of the land use right certificate that had been granted.
The People's Committee of Quang Binh province and the old provincial Inspectorate have issued many documents directing the People's Committee of the old Bo Trach district to accept and resolve his complaint regarding this content. However, the People's Committee of the old Bo Trach district still did not accept and resolve his complaint according to the authority prescribed by law.
Mr. Nguyen Van Uoc, Deputy Chief Inspector of the province, said: The provincial Inspectorate has issued many documents requesting the Chairman and People's Committee of Bo Trach district to handle the denunciation according to their authority, in accordance with the provisions of the 2018 Law on Denunciation regarding the content of the denunciation that the dossier for granting and changing the land use right certificate, house ownership rights and assets attached to land of Mr. Duong Viet Vuong lacked land area, and had signs of forged signatures during the process of preparing the dossier.

Most recently, on June 18, 2025, the Office of the People's Committee of the former Quang Binh province issued Document No. 3234/VPUBND-NC on verifying the content of the citizen's denunciation sent to the Chairman of the People's Committee of Bo Trach district with the following content: Considering Official Dispatch No. 360/TTr-NB1, dated June 9, 2025 of the Provincial Inspectorate on handling the citizen's petition, the Provincial People's Committee requested the Chairman of the People's Committee of Bo Trach district to accept and resolve according to authority, in accordance with the provisions of the 2018 Law on Denunciation regarding the content of the denunciation about the dossier for granting and changing the land use right certificate, house ownership rights and other assets attached to the land of the citizen lacking area.
On June 27, 2025, Vice Chairman of Bo Trach District People's Committee Nguyen Van Thuy signed instruction form No. 1060/HD-UBND with the following content: Based on the provisions of the 2018 Law on Denunciation and related legal documents, the Chairman of the District People's Committee instructed Mr. Duong Viet Vuong as follows: In case of denunciation of leaders of the District People's Committee, send a petition to the Chairman of the Provincial People's Committee; in case of denunciation of cadres and civil servants of the Bo Trach District Land Registration Office Branch, send a petition to the Quang Binh Provincial Land Registration Office for consideration and settlement in accordance with the provisions of law.
Mr. Vuong disagreed with the above instructions from the People's Committee of Bo Trach district. Mr. Vuong requested the Provincial People's Committee to direct the final handling of his petition and consider the responsibility of related individuals and groups.
