Overseas Vietnamese player Pham Thanh Tiep
Pham Thanh Tiep is a Vietnamese-Slovak player born in Slovakia, with Vietnamese parents. Thanh Tiep was born in 1996, trained at Banik Prievidza since he was 12 years old and played for the first team in 2017. After that, Thanh Tiep signed his first professional contract with SHB Da Nang Club in 2019.
Banik Prievidza FC is a football team playing in the Slovakian Third Division. After receiving information that Thanh Tiep returned to Vietnam to play for SHB Da Nang, Banik Prievidza FC sent a letter to the SHB Da Nang Club's leadership in April 2019, requesting payment of the player training fee according to FIFA regulations in the amount of 63,000 USD.
FIFA stipulates that any club that signs a professional contract with a player under the age of 23 must reimburse the initial training costs to the player's training facility.
However, SHB Da Nang did not respond to the incident even though Banik Prievidza had previously sent two more letters of request to the club competing in the V-League in May 2019 and June 2020. Finally, Banik Prievidza FC filed a lawsuit to FIFA through the International Transfer Connection System (TMS) in October 2020.
Upon receipt of the application, FIFA, pursuant to Article 13 of the Rules of Procedure of the Players' Committee and the Dispute Resolution Chamber, requested SHB Da Nang to pay USD 60,904.11, plus 5% interest per annum from the due date. In addition, FIFA emphasized that SHB Da Nang has the right to file an appeal and the deadline for receiving the application is November 25, 2020.
SHB Da Nang is at the bottom of the V-League 2023 rankings after 12 rounds.
By the end of December 2020, SHB Da Nang Club sent a letter to FIFA requesting to cancel the ruling, but it was not approved because it was 48 days late. Therefore, the Hoa Xuan Stadium team proactively sent a lawsuit to the Court of Arbitration for Sport (CAS) for a judgment, along with a fee of 20,000 USD.
In the appeal, the Han River football team said that the impact of the COVID-19 epidemic had led to a delay in responding to FIFA; affirming that this team belongs to the group of category 4 clubs - meaning that they do not have to pay training costs according to FIFA regulations.
"For the group of 3rd class clubs, the minimum cost of training young players is 10,000 USD per year, while for Da Nang it is 1,997.41 USD per year (about 45 million VND), which is below the 4th class standard. In addition, the average salary of Da Nang players is below 930 USD per month (about 22 million VND), also below the 4th class standard" - the content of the appeal reads.
In response to Da Nang’s appeal, FIFA stated that the club’s 48-day delay in responding showed a lack of responsibility, and asserted that the reason for the pandemic was not appropriate because all procedures could be done online. Therefore, CAS rejected SHB Da Nang’s appeal and requested that FIFA’s ruling be complied with, and compensation for Banik Prievidza Club was $73,000 (about VND1.8 billion).
