On November 11, the National Assembly discussed in the hall the draft Law on Civil Judgment Enforcement (amended) and the draft Law on Judicial Expertise (amended).
Speaking to clarify a number of issues of concern to delegates, Minister of Justice Nguyen Hai Ninh said that delegates had many opinions on the organizational model of the civil judgment enforcement system (CJES).
After 4 months of operation, the Minister of Justice affirmed that the coordination between the investigation agency, the People's Procuracy (PPC) and the People's Court (PPC) had no problems.
"However, when we reorganize, of course there will be some initial problems. However, the general trend, tendency and policy are very correct.
After 4 months of operation, the initial difficulties have been overcome. The project of the THADS agency system has been reported to the Government Standing Committee twice and to the Politburo twice.
The project attached to the Politburo's conclusion clearly states the organizational model, functions, tasks, advantages, disadvantages and solutions to overcome shortcomings and limitations," said the Minister.

According to the Minister, the regional THADS agency has been placed similarly and in agreement with 355 regional People's Courts and People's Procuracies. There is agreement on the number, scope, authority of operation, location of headquarters and similarity in name.
Currently there is no regional investigation agency, however the Minister said that there is still very close coordination. Although there is currently no regional THADS level, there is still a regional THADS office, ensuring good authority over judicial activities and coordination with the prosecution agencies.
Firstly, after 4 months of operation, the targets assigned by the National Assembly for the number of tasks and the amount of money were all exceeded, although the absolute number was very large, especially in major cases such as Tan Hoang Minh and Van Thinh Phat.
Second, it has comprehensively changed the organization, management and operation methods of the THADS system in a strong, digital transformation direction.
Currently, a series of software for making execution decisions and electronic receipts are being deployed. Of these, 75,455 execution decisions have been made on software, not on paper; over 375,000 electronic receipts have been issued, equivalent to VND 33,700 billion.
The Ministry is continuing to build enforcement software to carry out all enforcement operations in the electronic environment and build digital platforms.
The Minister said that recently, in the Van Thinh Phat case, with just one click, more than 8,800 billion VND was deposited into the accounts of more than 40,000 bondholders. Previously, with more than 40,000 bondholders, 40,000 paper copies were needed to each location, so this change in digital transformation has helped change all the activities of the regional THADS's operating method.
According to the Minister, in the draft law, the head of the THADS is not only an administrative position but also a judicial position, as the chief enforcement officer.
The revised Law on Administrative Procedures has cut up to 80% of administrative procedures, the remaining 20% is being simplified and in fact will be cut.
It is expected to reduce 30% in time and 13% in compliance costs based on a job with all the legal procedures that arise. This can be weighed, measured, and counted immediately.
