According to Dr. Pham Viet Thuan, Ho Chi Minh City Institute of Economics and Natural Resources, Resolution No. 316/NQ-CP of the Government has assigned tasks to ministries, branches and localities to rearrange the agricultural extension system and the Land Registration Office according to the two-level local government model.

The goal of this resolution is to streamline the apparatus, unify data and improve efficiency in serving people and businesses. However, the implementation shows that transferring functions to the commune level at this time still has many problems such as insufficient human resources; unsynchronized information technology infrastructure; the national land database is still in the process of completion. Based on the survey results in localities, the Institute of Natural Resources and Environment recommends maintaining the current model of the Land Registration Office Branch; only transferring this function to the commune level when the locality has sufficient human resources, data and technology.

Associate Professor Dr. Nguyen Dinh Tuan, former Principal of the University of Natural Resources and Environment, analyzed that if the transfer is made at this time, the commune level will face difficulties. At that time, the congestion and backlog of work that needs to be resolved will create bad consequences for the people.

The proposal to establish a new model when transferring the Land Registration Office Branches to the commune level is to establish a Land Registration Office at the provincial level (under the Department of Agriculture and Environment) to perform specialized State management functions; provide professional guidance to communes and wards and directly issue "pink books" to organizations... Associate Professor, Dr. Nguyen Dinh Tuan pointed out that at the commune level, the Center for Public Administrative Services and the Department of Economics - Infrastructure - Urban Areas have a department of land administration, environment, and construction, and this department will receive records on houses and land at the Center for Public Administrative Services.

Associate Professor Dr. Nguyen Dinh Tuan said that it is necessary to establish a Center for Natural Resources and Environment Technology. With the new model, these centers will undertake services such as measurement, mapping, extracting, consulting... to support the commune level. To facilitate the implementation of this work at the commune level, the centers will send 1-2 officers to participate at the commune level, together with the commune-level officers to participate in the process of handling land registration dossiers.

When organizing a model that clearly separates the two functions of State management and public services, the authority to register and issue "pink books" will be held by administrative officials. At that time, localities and specialized agencies will have the conditions to digitize and centrally manage land data. The organization of the administrative apparatus of the whole country will also reduce the 700 branches of the Land Registration Office that are currently maintained. This will also create a clear distinction when civil servants handle administrative work, and public employees will perform public services. This will reduce administrative costs, increase service efficiency and make working relationships transparent.

Lawyer Hoang Thi Thu, Director of HTVN Law Firm, said that in recent years, land disputes and lawsuits have occurred frequently, even developing into dangerous and complicated criminal cases. Therefore, every change in land needs to be carefully considered, ensuring the legislative aspect as well as the consensus and support of the people. Removing or keeping the model of the Land Registration Office Branch is an urgent issue but also a difficult problem. Therefore, only when both the transferring agency and the receiving agency are ready, meeting the requirements in terms of personnel, equipment as well as having a clear legal mechanism can it be implemented.
