6 latest important revisions in the draft revised Housing Law

Continuing the meeting program between the 2 sessions of the 6th Session, on the afternoon of November 16, at the National Assembly House, under the chairmanship and direction of National Assembly Chairman Vuong Dinh Hue, the National Assembly Standing Committee gave opinions on the draft amended Housing Law and the draft amended Real Estate Business Law.

Reporting on a number of major issues in explaining, accepting and revising the draft revised Housing Law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that on the afternoon of October 26, 2023, the National Assembly discussed the draft revised Housing Law in the hall.

Immediately after the meeting, implementing the direction of the National Assembly Standing Committee (NASC), the Standing Committee of the Law Committee closely coordinated with the drafting agency and relevant agencies to synthesize, explain, absorb and revise the draft Law according to the opinions of the National Assembly deputies (NADs).

Regarding the issues that have been agreed to be accepted and revised, Chairman of the Law Committee Hoang Thanh Tung said that the draft Law has been accepted and revised on the following major contents:

(1) Amend Article 57 on multi-storey, multi-apartment housing of individuals to overcome existing shortcomings and limitations in the past, strengthen strict management but still ensure to meet the needs of a part of the population for this type of housing;

(2) The Vietnam General Confederation of Labor is the governing body of investment projects to build social housing for workers and laborers who are eligible for social housing policies to rent in Clause 4, Article 80;

(3) Amend the regulations on incentives for investors of social housing projects at Point d, Clause 2, Article 85 in the direction of inheriting the provisions of the current housing law to supplement the right to build commercial housing within the land fund of 20% of the total residential land area within the project scope, but investors must pay land use fees for this area according to the provisions of the land law to both attract investment and strictly manage state budget revenue;

(4) Regulations on construction of workers' accommodation in industrial zones in Article 94; no regulations on workers' accommodation outside industrial zones;

(5) Add Clause 3, Article 95 on the investment project to build workers' accommodation in industrial parks must be approved by the Industrial Park Management Board in terms of investment policy and investor approval in accordance with the provisions of the law on investment to ensure consistency with the Investment Law;

(6) A number of other major policy contents have been unanimously accepted and revised as shown in the draft Law.

Regarding the earlier implementation of the content on social housing in the Housing Law; the implementation of the Housing Law and the Land Law, the Standing Committee of the Law Committee stated that in case the Housing Law is passed at this session before the Land Law, it is requested that the Standing Committee of the National Assembly consider and give instructions on the following contents:

(1) Unify the effective date of the Housing Law (and Land Law) as January 1, 2025 to have a basis for regulation in the draft Housing Law (amended) submitted to the National Assembly for approval. Determining the effective date is also consistent with the Land Law (expected to be approved by the National Assembly at the latest at the 7th session (May 2024)) so that the Government can promptly issue detailed regulations and implementation instructions, meeting the urgent requirement of putting the Law into practice.

(2) Direct the reception and revision of the draft amended Land Law to ensure consistency with the policy contents of the Housing Law (amended) agreed by the Standing Committee of the National Assembly according to Report No. 661/BC-UBTVQH15 dated October 22, 2023 on the explanation, reception and revision of the draft amended Housing Law and reflected in the draft amended Housing Law.

3) Regarding some other policy issues of the Land Law related to the Housing Law that require consultation with competent authorities or need to continue to discuss and give opinions before having a plan for adjustment, the Standing Committee of the Law Committee proposes that the Standing Committee of the National Assembly allow acceptance in the direction: The Housing Law does not have specific regulations but refers to implementation according to the Land Law to ensure caution and strictness.
