
Promote decentralization to localities
Delegate Pham Van Hoa ( Dong Thap Delegation) is interested in decentralization and delegation of power in the management of national reserves; deciding on the import and export of national reserves to increase initiative and responsibility in decision-making.
The delegate said that the provisions in the draft Law are very clear. The delegate gave an example of the recent floods in the Central region, the decentralization and delegation of authority to ministries, branches as well as provincial People's Committees to carry out this task quickly and promptly, without having to wait for orders from the Prime Minister or the Government.

In which, the Ministry of Health exports insurance and medicine; the Ministry of Agriculture and Environment exports relief food; especially the role of the Provincial People's Committee is to export goods in a timely manner.
"I agree with decentralization and delegation of power like this, but the drafting agency needs to clarify the role and responsibility of the Ministry of Finance as both an advisor and a supporting agency to manage national reserves," the delegate suggested.

Meanwhile, delegate Ha Sy Dong (Quang Tri delegation) proposed stronger decentralization to localities. According to the delegate, in case of emergency, it is recommended that the Chairman of the Provincial People's Committee be allowed to decide to temporarily release reserve goods within a certain limit and report to the Ministry of Finance within 24 hours; at the same time, issue a threshold for food and rescue supplies that localities can decide on when there are storms, floods, landslides, and large-scale epidemics.
Delegate Duong Khac Mai (Lam Dong Delegation) is interested in demarcating national reserve areas and establishing national reserve bases so that we can respond promptly to unusual conditions like in the recent past.

Delegate Duong Khac Mai proposed that in the context of natural disasters such as floods, it is necessary to combine both emergency relief and civil defense. He said that it is necessary to synthesize resources to focus on handling in order to respond more effectively in emergency situations.
Strategic reserves must be tightly managed.
Delegate Nguyen Minh Tam (Quang Tri Delegation) was concerned about Clause 1, Article 8 of the draft Law, which stipulates that national reserve goods and strategic reserve goods must be strictly managed, safe, and secret according to the provisions of the law on protecting state secrets.

According to the delegate, management information on national reserve goods is the subject of state secrets and is regulated according to the provisions of the law on state secret protection. Are national reserve goods also subjects in this Law on State Secrets?
Therefore, the delegate suggested that the drafting agency study to have clearer regulations on which goods are classified as secret, and not include common goods, to facilitate the implementation of the law.

Minister of Finance Nguyen Van Thang, on behalf of the drafting agency, made a statement explaining and receiving comments from National Assembly deputies. Regarding traditional national reserve activities as at present, the Ministry of Finance has reviewed, adjusted and supplemented current laws to suit the actual situation, increased decentralization and delegation of power, drastically cut unnecessary administrative procedures to ensure consistency with the laws passed by the National Assembly and create maximum favorable conditions in the implementation process.
Minister Nguyen Van Thang said that recently, natural disasters and floods occurred in many provinces, especially in the Central region, but the work of stockpiling goods, allocating warehouses, and decentralizing and decentralizing distribution was carried out very well.
According to the Minister, the Law was issued but in reality, the developments are very complicated and no provision of the law can cover it all. In fact, the Ministry of Finance has implemented the issuance and coordination with localities to implement it immediately when needed, all processes and procedures are done later. "The post-audit process is also very good, most of the work from bidding, purchasing to issuance has not had any bad reputation anywhere", the Minister informed.
Regarding the regulation on strategic reserves, the Minister said that this is a very new and difficult issue, affecting many legal policies, industry and sector strategies that have been issued and affecting many ministries, branches, localities and enterprises.
Therefore, the draft law stipulates basic principles, defines the management mechanism, and uses strategic reserves to be assigned to specialized management agencies for implementation, ensuring the principle of law-making in the direction of only regulating contents under the authority of the National Assembly and assigning the Government to regulate each period in accordance with the actual situation.
Regarding the issue of socialization in national reserves, the Minister said that the draft Law has an important step forward in promoting the socialization of national reserve activities, contributing to diversifying resources and enhancing flexibility in national reserves, and as delegates said, reducing the burden on the state budget.
