9 cases of "car modification" will no longer fail vehicle inspection from February 15

The Ministry of Transport issued Circular 43/2023/TT-BGTVT amending Circular 85/2014/TT-BGTVT regulating the renovation of road motor vehicles, Circular 42/2018/TT-BGTVT and Circular 16/2022/TT-BGTVT amending Circulars in the field of vehicle inspection.

Circular 43/2023/TT-BGTVT takes effect from February 15, 2024.

Changes in regulations when modifying motor vehicles

According to Circular 43/2023/TT-BGTVT, the truck bed of an unused truck imported or manufactured or assembled within 6 months from the date of issuance of the first Inspection Certificate and Inspection Stamp to the date of submission of the design dossier (except for the case of conversion into a driving practice vehicle, driving test vehicle; conversion and installation of an additional cover for an open-body truck). Compared to the current Clause 3, Article 4 of Circular 85/2014/TT-BGTVT, it is stipulated that the truck bed of an imported, manufactured or assembled truck that has never been used shall not be converted within 06 months from the date of the first technical safety and environmental protection inspection to the design appraisal.

Do not modify the braking systems, suspension systems and steering systems of motor vehicles, except in the following cases: Modification, installation or removal of auxiliary brake pedals on driving practice vehicles and driving test vehicles; Modification to supply energy and control the braking system of trailers and semi-trailers; Modification of right-hand drive motor vehicles; Modification of control mechanisms and seats to suit the motor functions of disabled people driving vehicles.

Modifications as requested by the vehicle manufacturer (with written confirmation from the vehicle manufacturer or the vehicle manufacturer's legally authorized representative stating the proposed modification content, along with instructions and a list of components and assemblies used for replacement) in the following cases: For the brake system: changing some components and assemblies of the brake system to eliminate potential safety risks or to improve braking efficiency; For the steering system: changing some components and assemblies of the steering system to eliminate potential safety risks or to improve comfort and safety; For the suspension system: changing some components and assemblies of the suspension system by installing components and assemblies with equivalent load-bearing capacity (not for the purpose of increasing the weight of the cargo) to eliminate potential safety risks.

Do not modify and install double-decker sleeper beds on passenger vehicles, except in cases where the vehicle was previously a passenger vehicle with double-decker sleeper beds. Current regulations do not modify and install double-decker sleeper beds on passenger vehicles.

Do not modify or change the distance between the axles of a motor vehicle, except in the following cases: conversion into a specialized vehicle or tractor; conversion to shorten the wheelbase when converting back into a motor vehicle before the first conversion; and conversion to reduce the overall length and size of the vehicle body of a dump truck, tanker truck, or truck in accordance with the provisions of Circular 42/2014/TT-BGTVT regulating the body of a dump truck, tanker truck, or truck participating in road traffic.

The total mass and total mass distributed to each axle allowed to participate in traffic of a motor vehicle after conversion must not exceed the total mass and total mass distributed to each axle according to the manufacturer's design and regulations on axle load limits and total vehicle weight limits.

Cranes, tankers carrying dangerous goods, tankers carrying compressed gas and liquefied gas when installed on modified motor vehicles must be inspected and certified for their features, quality and technical safety by organizations that have been certified to be qualified to conduct technical inspection of labor safety in the field of transportation according to the provisions of Decree 44/2016/ND-CP detailing a number of articles of the 2015 Law on Labor Safety and Hygiene on technical inspection of labor safety, training in labor safety and hygiene and monitoring of the working environment.

The replacement engine has a maximum capacity as announced by the manufacturer that is between 90% and 120% of the maximum capacity of the engine being replaced.

9 cases where motor vehicles have changes but are not considered renovations

Accordingly, Circular 43/2023/TT-BGTVT adds Article 4a to Circular 85/2014/TT-BGTVT regulating cases where motor vehicles have changes but are not considered renovations.

First, change the passenger compartment door (not including changing the door position and size).

Second, changing some cargo container structures such as: sealing or changing the structure of the cargo container door; replacing flat corrugated iron sheets with corrugated iron sheets or vice versa; adding corrugated iron sheets to the roof frame of covered vehicles without increasing the height of the cargo container wall (Hc) as prescribed in Appendix I issued with Circular 43/2023/TT-BGTVT; adding or removing dust covers for the cargo container of dump trucks.

Third, install, replace or remove the cover of the cargo compartment and luggage of the PICKUP car without changing the size of the cargo bed and the size of the vehicle.

Fourth, install additional separate fog lights.

Fifth, replace the front light cluster with a cluster that has been certified or declared to comply with the National Technical Regulation on optical characteristics of front lights of road motor vehicles, QCVN 35:2017/BGTVT without having to modify the vehicle's structure to ensure installation.

Sixth, replace the bulb in the front light cluster with another type of bulb with equivalent power consumption without having to intervene or change the structure of the light cluster.

Seventh, changing the details and body parts is optional for the vehicle manufacturer but does not change the exterior dimensions of the vehicle, except for the cases specified in Article 6 of Circular 85/2014/TT-BGTVT. Installation is carried out according to the recommendations of the vehicle manufacturer or the legally authorized representative of the vehicle manufacturer.

Eighth, changes in the design of some details of the car body such as: front grille, spoiler.

Ninth, install additional windshield on the truck cabin roof, steps, exhaust pipe decoration, decorative belts to protect headlights and signal lights without changing the exterior size of the vehicle.

Changes to motor vehicles as prescribed above without changing the vehicle type specified in Appendix XI issued with Circular 43/2023/TT-BGTVT and meeting the requirements on technical safety and environmental protection according to the corresponding National Technical Regulations shall be inspected for technical safety and environmental protection of road motor vehicles to be granted an Inspection Certificate and Inspection Stamp.

12 cases are exempted from preparing design documents for modified motor vehicles

Specifically, cases exempted from preparing design documents for modified motor vehicles from February 15, 2024 include:

Driving practice and testing cars install or remove an auxiliary brake pedal by connecting it to the main brake pedal via a mechanical actuator lever.

Add or remove dust covers to the dump truck bed without changing the bed dimensions.

Installing, replacing or removing the cover for the cargo compartment or luggage of a PICKUP car changes the size of the cargo bed but does not change the overall size of the vehicle.

Dump trucks and tank trucks imported, manufactured, assembled, or modified before November 1, 2014 must voluntarily reduce the volume of their cargo and tank containers to comply with the provisions of Circular 42/2014/TT-BGTVT.

Remove the fuel supply system using liquefied petroleum gas (LPG) or compressed natural gas (CNG) for the vehicle's engine for motor vehicles that have been modified to install an additional fuel supply system (LPG, CNG) and return to using only the fuel supply system of the motor vehicle before the fuel supply system was modified.

Renovation and change of position of axles, axle clusters, and towing pins until December 31, 2015 for semi-trailers (except dump semi-trailers) and semi-trailers carrying containers with total mass allowed to participate in traffic less than total mass according to design.

Renovation according to sample design announced by Vietnam Register.

Install, replace or remove a car roof rack following the manufacturer's instructions without changing the overall width of the vehicle.

Install, replace or remove the roof visor on the cab of the tractor.

Install, replace or remove the pump, oil tank and hydraulic piping system of the tractor to drive the cargo lifting system of the dump semi-trailer.

Changes to the passenger seating arrangement or cargo door or cargo lining material

Trucks that install or replace cargo lifting equipment of cargo containers that have a safety certificate from a competent authority or remove this equipment.

Additional responsibilities of auto repair facilities

Add Article 14c to Circular 85/2014/TT-BGTVT on the responsibilities of rehabilitation facilities, including:

Carry out motor vehicle renovation in accordance with the approved design, ensuring that the renovated motor vehicle meets the requirements on technical safety and environmental protection as prescribed in this Circular.

Responsible for the origin and quality of components, assemblies, and materials for renovation.

Responsible for checking the quality of the converted motor vehicles and preparing the acceptance report of the converted motor vehicles according to the provisions of Clause 3, Article 9 of this Circular.

Be responsible for the accuracy of records and documents as prescribed in Clause 1, Article 10 of this Circular to provide to vehicle owners to submit the acceptance records of modified motor vehicles to the acceptance agency.

Use the results of weighing the mass of the vehicle distributed on each axle of the unit with the function of weighing mass according to the regulations of the law on measurement or the renovated facility self-equipped with weighing equipment that meets the regulations of the law on measurement.
