iCloud's Advanced Data Protection feature allows users to encrypt and protect data like photos, wallet cards, device backups, and messages, making it impossible for even Apple to access user data.
However, this may be meaningless as the UK Home Secretary has sent Apple a “technical capabilities notice” demanding that the company provide backdoor access to encrypted iCloud storage under the “Investigatory Powers Act 2016”. The law allows law enforcement agencies to demand that companies cooperate in gathering evidence and can apply to services provided in countries other than the UK.
Advanced Data Protection enables end-to-end encryption of data on iCloud
The backdoor notice applies not only to UK users but also to US users. Apple has the right to appeal the request to a judge to determine its reasonableness, and to convene a technical committee to consider the cost of compliance. However, Apple cannot delay its response while the appeal is pending.
Apple won't offer iCloud encryption in the UK?
When amendments to the Investigatory Powers Act were discussed in March 2024, Apple expressed strong opposition to the request, stressing that "the UK Government has no authority to prevent people around the world from enjoying the proven security benefits of end-to-end encryption."
Advanced Data Protection is a cloud storage feature that even Apple cannot unlock, and its launch in the US has been delayed due to opposition from the FBI. Apple and many privacy groups have criticized the government's request to create backdoors into encryption systems, arguing that it violates users' privacy and security.
Meredith Whittaker, president of encrypted messaging app Signal, said the UK government's move to weaken the security of storage encryption would create weak cybersecurity and harm the global economy.
The Washington Post also notes that Apple may stop providing encrypted storage in the UK rather than break its privacy commitments to global users. However, such a concession would not satisfy the UK’s demand for backdoor access to its services in other countries.
