On the afternoon of May 7, during group discussions on three draft laws (draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution; Law on Organization of Local Government (amended); Law on Cadres and Civil Servants (amended), delegates from the Ho Chi Minh City National Assembly Delegation gave frank and constructive comments, proposing many contents that should be included in the draft laws.

Concerns about removing the regulation that People's Council delegates are not allowed to question the chief justice and the chief prosecutor

The draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution proposes to amend and supplement in the direction of not stipulating that the chief justice of the people's court and the chief prosecutor of the people's procuracy are within the scope of subjects answering questions from People's Council deputies. The questioning of People's Council deputies will focus on the People's Committee (chairman of the People's Committee, other members of the People's Committee and heads of agencies under the People's Committee).

Discussing at the Ho Chi Minh City National Assembly Delegation, delegate Truong Trong Nghia said that after studying the comparison table, he agreed with the amendments in the draft. However, it is necessary to retain the provision of "questioning" of People's Council delegates with the chief justice of the people's court and the chief prosecutor of the people's procuracy to demonstrate democracy and up to now, this right has been regulated like that and is being promoted well.

Commenting on Article 84 regulating socio -political organizations under the Vietnam Fatherland Front, delegate Truong Trong Nghia was concerned about the word “under the Vietnam Fatherland Front”, because we have defined the Vietnam Fatherland Front as a political alliance, a voluntary union of political and socio-political organizations. According to the delegate, other concepts should be used to express the “voluntariness” and “alliance” nature.

“Perhaps, we want to build a broader solidarity and a broader gathering. As the General Secretary has said in some speeches, we accept differences to build a prosperous and civilized country. I think, we should have some regulations to expand the Fatherland Front force in the country, to make it more attractive and appealing,” said delegate Truong Trong Nghia.

Commenting on the draft resolution, delegate Tran Hoang Ngan expressed his joy when reading the draft resolution when the phrase “local government at two levels” appeared. Delegate Tran Hoang Ngan shared that he partly agreed with delegate Truong Trong Nghia’s viewpoint when he said that only provincial-level People’s Council delegates can question the Chairman of the People’s Committee, other members of the People’s Committee, the Chief Justice of the People’s Court, and the Chief Prosecutor of the People’s Procuracy at the equivalent level. Meanwhile, commune-level People’s Council delegates cannot question because the commune level does not have a Chief Justice or Chief Prosecutor.

Regarding the draft Law on Cadres and Civil Servants (amended), according to delegate Pham Khanh Phong Lan, the regulation of what cadres and civil servants are not allowed to do, including "not allowed to participate in strikes", makes delegates concerned. Because strikes are also a basic human right (of course, how to strike in an organization). "This issue is unreasonable, the drafting committee must review, why is it included in the prohibition", delegate Pham Khanh Phong Lan raised the issue.
