On the morning of November 14, the National Assembly discussed in the hall the draft Law on Construction (amended).

Receiving and explaining at the discussion, Minister of Construction Tran Hong Minh affirmed that the opinions raised by the delegates were valid, viewed from many perspectives and derived from practice, contributing significantly to the improvement of institutions in the construction sector, ensuring the process of organizing and implementing the law is serious and strict.

Regarding construction licensing and construction order management, according to the Minister, the current reality is still inadequate. During the implementation of planning steps, project appraisal, technical design, the management agency has fully controlled the requirements on scale, investment objectives, structure, fire safety; however, before implementation, people and businesses still have to apply for a license, which is unreasonable.

To overcome this, the draft Law has amended and supplemented regulations to only grant licenses for constructions outside the planning scope or with a scale of more than 7 floors.

Special projects still require design consulting, but the procedures are simplified and do not require complicated or elaborate documents. At the same time, the implementation time is shortened from 30 days to 7-10 days, but safety must still be ensured according to the provisions of Decree 06/2021 on structural safety, architecture, fire prevention, electricity and water.

Regarding the project management board model, Minister Tran Hong Minh said that there are currently many types of management boards from central to local levels, causing resource dispersion. The draft Law only maintains two types of management boards: professional management boards at the ministry/industry/province level and project management boards at the commune level. In which, the commune level can organize its own management board or hire consultants if it lacks capacity, and the cost is taken from the project management cost.

Regarding construction quality management, according to the Minister, up to now, it has been carried out in full steps from acceptance of each job, by item, acceptance of phase transition, completion of phase, acceptance for putting into use, when the warranty period expires and acceptance of equipment...

"These regulations have been clearly stated in the acceptance procedures and decrees as well as guiding circulars of the construction industry. Over the past years, the implementation has been carried out very strictly" - the Minister informed.

Regarding a number of incidents related to construction quality such as the Lo River bridge case, which is being investigated by authorities to clarify the cause, Minister Tran Hong Minh affirmed that in terms of law, the current legal regulations are complete and the implementation is carried out by the investor, consultant, supervisor.

Regarding the opinions of some delegates on construction materials, the Minister said that the construction industry has standards and regulations for using materials that meet the conditions of green, clean, and smart urban areas, so it is recommended that when implementing projects, research and application should be done to ensure the environment and health of the people.

Along with that, the Minister said that it is necessary to abolish construction practice certificates and business capacity certificates at all levels to avoid the negative mechanism of asking and giving for organizations that issue certificates.

"The capacity of an enterprise has been confirmed when participating in bidding and designating contractors, including conditions on capacity, machinery and equipment, staff qualifications, financial capacity, etc. Therefore, regulations on enterprise capacity certificates are not necessary" - the Minister affirmed.

Regarding the responsibilities of entities in construction activities, Minister Tran Hong Minh emphasized that the draft Law clearly stipulates that investors and consultants must take maximum responsibility for the quality of the project, eliminating the situation of "contracts for reference only" as before, helping to reduce errors and risks during implementation.
