Teachers are banned from tutoring regular students to 'avoid giving teachers a bad reputation'

In a report sent to National Assembly delegates before the 9th session's question-and-answer session, Minister Nguyen Kim Son continued to propose adding tutoring and extra learning to the list of conditional business lines.

Minister of Education and Training Nguyen Kim Son reported on a number of issues related to the group of questions at the 9th session.

As planned, Minister Nguyen Kim Son is one of two members of the Government who will answer questions at this session. The question and answer session is scheduled to take place on June 19 and the morning of June 20.

The content of implementing legal regulations on extra teaching and learning is included in the group of issues that the National Assembly decided to question Minister Nguyen Kim Son.

Circular 29 regulates the management of extra teaching and learning, but "does not prohibit" it.

The report states that the issue of private tutoring is not a new one. Nearly three decades have passed, with legal regulations on private tutoring, the warning about widespread private tutoring remains relevant.

Instead of decreasing, private tutoring and learning are increasingly taking place on a larger scale in many forms.

This not only puts great pressure on students and their parents, but also goes against the spirit of innovation in Resolution 29/2013 on fundamental and comprehensive innovation in education and training, which aims to shift from "transferring knowledge" to "developing learners' qualities and capacities".

Contrary to the goal of the 2018 general education program that emphasizes building people who are autonomous, creative and capable of lifelong learning, rampant extra teaching and learning is undermining the true value of learning.

Correctly assessing the importance of properly managing extra teaching and learning to limit the consequences of widespread extra teaching and learning and improve the quality of education, in the draft Law on Teachers, the Ministry has advised the Government to include violations of regulations on extra teaching and learning as regulations that teachers are not allowed to do.

According to Minister Nguyen Kim Son, the Ministry of Education and Training has issued Circular 29 regulating extra teaching and learning.

Circular 29 regulates the management of extra teaching and learning, but "does not prohibit it". The organization of extra teaching and learning must ensure that it does not affect the organization and implementation of the school's educational plan, and does not affect the implementation of the subject program and the teaching plan of teachers.

The ministry's viewpoint is to direct schools to not have extra classes, to strengthen and improve the quality of regular school hours...

Initial results show that the circular's regulations limit the widespread and illegal situation of extra teaching and learning.

Schools focus on improving the quality of teaching and learning of the main curriculum, ending paid extra teaching in schools, creating conditions for students to access knowledge without pressure on studying and finances...

The regulation that teachers are not allowed to teach students assigned by the school will avoid bad reputation for teachers who give legitimate extra lessons, and strengthen the prestige and honor of teachers.

Teachers' awareness of income tax obligations and the value of professional self-improvement has changed. Circular 29 has received high consensus and special attention from society, so it has been quickly grasped and promptly implemented, meeting society's expectations...

Regarding limitations, Minister Nguyen Kim Son assessed that from 2020, when private tutoring and private learning are no longer conditional business lines, management becomes more difficult, and localities do not know the sanctions to handle violations.

The list of acts requiring administrative sanctions in the education sector currently lacks some violations of regulations on extra teaching and learning that need to be supplemented (currently, localities have proactively based on the sanctions regulations under the Law on Civil Servants and Public Employees and other relevant laws to handle violations)...

Since implementing Circular 29, some localities have not issued regulations on extra teaching and learning according to their authority, leading to confusion in implementation.

Coordination between departments and branches in implementing regulations on extra teaching and learning outside of school is not timely and drastic in some places, so there are still cases of intentional violations of circular regulations on extra teaching and learning outside of school.

Need systematic, synchronous and drastic solutions

The report clearly stated many reasons, including the fact that when tutoring and extra-curricular learning services were removed from the list of conditional business lines, in some localities, tutoring and extra-curricular learning in and out of schools became uncontrolled and spontaneous due to the inability to manage the licensing of tutoring and extra-curricular learning.

To help manage tutoring and learning activities in localities and educational institutions more closely, the Ministry has repeatedly recommended and proposed to the Government and the National Assembly to include tutoring and learning services in the list of conditional business lines of the Investment Law at the 9th session of the 14th National Assembly. However, to date, this proposal has not been approved.

Therefore, Circular 29 aims to not stipulate conditions (to manage conditional business lines). But emphasizes the most basic management solutions to ensure the quality of education...

Mr. Son stated that extra teaching and learning is a complex issue with great social impact. Therefore, a circular regulating the management of extra teaching and learning cannot solve all the problems.

It is necessary to have systematic, synchronous and drastic solutions. Implementation needs to have a roadmap, and at the same time, the solutions must be modern and updated with advances in science and technology.

One of the proposed solutions is to continue to propose that the Government include tutoring and extra-curricular services in the list of conditional business lines.

This aims to make extra teaching and learning activities transparent, ensure safety for learners, ensure legitimate interests of teachers, strengthen state management and ensure tax collection for businesses that organize extra teaching.
