Decree No. 178/2024 of the Government on policies and regimes for cadres, civil servants, employees and armed forces when implementing organizational restructuring has many notable policies.


Deputy Prime Minister Nguyen Hoa Binh signed and issued Decree No. 178/2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the process of restructuring the apparatus of the political system.

Accordingly, the Government stipulates that officials who cease to hold leadership positions due to organizational restructuring will retain their old position salary or old leadership position allowance until the end of their term.

Retain salary or allowance of old position

The Decree clearly stipulates policies for cadres, civil servants, and public employees who are leaders or managers and are removed from leadership or management positions or are elected or appointed to lower leadership or management positions due to organizational reorganization.

Cadres, civil servants, and public employees who are leaders or managers due to organizational reorganization or are elected or appointed to a lower leadership or management position will have their old salary or leadership allowance retained until the end of the election term or term of office.

In case the position has been held for an elected term or the appointment term is less than 6 months, it will be reserved for 6 months.

Policy for early retirement

Regarding the policy for people retiring early, Decree No. 178/2024 stipulates that if they have 10 years or less left under normal working conditions, or 5 years or less left before retirement age in particularly difficult areas, people retiring early are entitled to three regimes.

First , a one-time pension benefit for early retirement.

If you take 12 months off with less than 5 years left before retirement age, you will receive a benefit equal to one month of current salary multiplied by the number of months of early retirement.

If the remaining age is between 5 and 10 years, the corresponding benefit will be 0.9 months' salary for each month of early retirement (up to 60 months).

If you take leave from the 13th month onwards, the benefit level will be 0.5 of the previous benefit level.

Second , receive a pension without being subject to early retirement deductions, along with early retirement benefits.

If there are 2 to 5 years left, civil servants will receive a subsidy equal to 5 months of current salary for each year of early retirement.

If there are still 5 to 10 years left, the benefit will be 4 months salary for each year of early retirement.

These people will also receive benefits based on their working time and have paid more than 20 years of compulsory social insurance.

Third , if there is not enough time in a leadership position to be rewarded, civil servants will also be considered for rewards.

Encourage cadres to go to strengthen the base for 3 years

The Government's Decree also stipulates that cadres, civil servants and public employees in central and local agencies who are assigned by competent authorities to work on a three-year basis at the grassroots level will enjoy many policies.

For cadres, civil servants and public employees assigned to work at Party and State agencies and public service units at the commune level, the Government stipulates that they are entitled to receive salary (including allowances) according to their job position before being assigned.

In addition, a one-time allowance equal to 10 months of basic salary at the time of taking up the job. In case the working unit is located in an area with particularly difficult socio -economic conditions, it will enjoy policies and regimes according to regulations.

After completing the task well, you will be accepted back to the agency or unit where you were sent and your salary will be raised one level higher. If you are assessed as completing the task well or better, you will be considered for a reward.

For cadres, civil servants and public employees in central agencies who are assigned to work at public agencies and units at provincial and district levels, the decree clearly states that they will receive salary (including allowances) according to their job position before being assigned.

At the same time, a one-time allowance equal to 3 months of basic salary at the time of taking up the job. In case the unit is working in an area with particularly difficult socio-economic conditions, it will enjoy policies and regimes according to regulations.

After completing the task well at the base, being accepted back to the agency, the salary will be raised by one level. If the task is assessed as completing the task well or better, the ministry, department, branch and province will consider rewarding according to the Law on Emulation and Commendation.

This Decree comes into force from January 1, 2025.

At the same time, assign the responsibility of guiding and organizing implementation to the Ministries, branches at the central level; Provincial People's Committees and agencies, organizations and units directly managing and using cadres, civil servants, public employees and workers in promulgating assessment criteria and conducting a comprehensive review of the quality of cadres, civil servants, public employees and workers under their management.

On that basis, identify the subjects who must quit their jobs due to rearrangement under the scope of this Decree to arrange a streamlined organization, reduce staff, restructure and improve the quality of the staff, civil servants and public employees, and improve the effectiveness and efficiency of operations.
