Proposal to supplement regulations on professional ethics for engineers, architects, investors and contractors
Speaking at the discussion at Group 1 (Hanoi City delegation) on the draft Law on Construction (amended), delegate - Most Venerable Thich Bao Nghiem expressed great concern about the issue of social responsibility and ethics in construction. The Venerable suggested that the drafting agency study and develop the Law on the basis of balancing economic - social - environmental - cultural benefits.
According to the delegate, it is necessary to strengthen legal education and public ethics for officials in the construction industry, so that all projects have a "good heart", serving the people and the country, not for personal gain. The delegate proposed to supplement regulations on professional ethical responsibilities of engineers, architects, investors and contractors, and to respect reputation and professional conscience.

"In recent days, public opinion has been very concerned about the case of the Lo River Bridge in Doan Hung Commune, Phu Tho Province - a large project that has been put into use for more than 10 years and has been severely damaged, raising questions about the quality of construction, supervision and acceptance. This causes traffic insecurity, affects the lives of people on both sides of the river, and puts pressure on state agencies. This incident shows the need to improve legal standards, responsibility for management and supervision of construction works because current laws may not be strong enough in terms of sanctions and criminal responsibility for poor quality works or unclear about the roles and responsibilities of related parties (investors, construction units, supervision organizations...), the delegate cited.
Therefore, according to Venerable Thich Bao Nghiem, the amendment and completion of the Construction Law has become extremely urgent and has profound significance in many aspects. "It is not only about perfecting the State management tools but also about building a strong foundation of ethics and professional culture, a safe, sustainable, humane construction for the happiness and safety of the people," the delegate emphasized.
It is recommended that there must be a separate supervision consulting unit, so that the investor cannot "both play football and blow the whistle"
Commenting on the Law on Construction (amended), delegate Nguyen Anh Tri (Hanoi delegation) also said that there should be regulations on construction supervision.
According to delegate Nguyen Anh Tri, the provisions in the draft can be understood as the investor has the right to supervise the construction of the project when it has sufficient capacity and is responsible for its supervision. The delegate believes that there should be strict sanctions for supervision consultants when mistakes occur.
"I propose that this regulation should not be made. Because this is a situation of "playing football and blowing the whistle at the same time", building but supervising at the same time is not allowed. Supervision must have its own supervision consulting unit", Mr. Tri said.

Citing the Lo River Bridge (Phu Tho) case, delegate Nguyen Anh Tri shared: "Following the information, I am truly heartbroken. In my opinion, the supervisory consultant must have known about this. When I was the Director of the National Institute of Hematology and Blood Transfusion, I was the investor in building 5 blood transfusion center projects nationwide. And I know, the supervisory consultant must have known. But here, why did the supervisory consultant ignore it?"
According to Mr. Tri, the first cause of the incident could be due to lack of responsibility and another reason Mr. Tri mentioned is that "maybe they ignored it for the sake of profit, agreed to build it like that to embezzle money".
From personal analysis and comments, delegate Nguyen Anh Tri suggested that the construction and supervision units cannot be one but must be clearly separated.
"Supervision consulting is a profession that requires independence, qualifications, knowledge, and responsibility," said delegate Nguyen Anh Tri.
