On November 6, within the framework of the 10th Session of the 15th National Assembly, National Assembly deputies discussed in groups related to many important law projects. The National Assembly delegation of Hue City discussed in group 6, along with the delegations of Dong Nai and Lang Son.
Tightly manage resources, avoid legal cross-fertilization
Delegate Nguyen Hai Nam (National Assembly Delegation of Hue City) said that when discussing amendments to the Construction Law, it is impossible to separate the relationship between planning, architecture and administrative institutions.
According to Mr. Nam, the overlap between the Construction Law, Planning Law, Land Law, etc. is making the process of managing and implementing urban projects complicated and time-consuming. Delegate Nguyen Hai Nam suggested that during the revision process, it is necessary to properly implement the direction of the General Secretary and the Prime Minister, which is to "drastically cut down administrative procedures, reduce unnecessary business conditions but improve the quality of management, especially in urban planning and renovation".
“Reality is the measure of institutional reform. How to make the city free of traffic jams and floods, schools near residential areas, convenient medical services, that is the quality of livable planning,” Mr. Nam emphasized.
He also proposed to strengthen post-inspection instead of pre-inspection, clearly establish responsibilities between levels, and avoid the situation of "running around in circles" in management and law enforcement.
Regarding the Law on Geology and Minerals (amended), delegate Nguyen Hai Nam said that it is necessary to unify the management of geological information and data and clearly distinguish between basic investigations and mining activities. Mr. Nam pointed out the reality: Enterprises are currently facing many difficulties when applying for mining licenses because they have to carry out a series of complicated legal procedures, from compensation, resettlement to approval of mine closure. Mr. Nam noted: "If not well controlled, mineral exploitation will cause loss of resources, landslides, water pollution, landscape deformation and increase the risk of occupational accidents."
From the reality in Australia, he believes that Vietnam needs to learn the process of environmental restoration after mining, planting trees, restoring land, and returning natural space. Revenue from minerals, according to him, must be managed transparently, with priority given to reinvestment in infrastructure and livelihoods of people in mining areas. Mr. Nguyen Hai Nam also proposed stricter regulations on sand mining, linked to national marine spatial planning and climate change adaptation strategies, so that geology can truly become a leading science and technology field, serving sustainable development.
Need for a national coordination board on organic agriculture
Delegate Nguyen Thi Suu, Deputy Head of the National Assembly Delegation of Hue City, gave comments on the group of laws in the fields of agriculture and environment, especially the Law on Organic Agriculture and Biosafety.
Ms. Suu believes that this is the “legal intersection” of three pillars: Agriculture - Environment - Biology, because it is closely related to at least 7 of the 15 current laws such as: Law on Cultivation, Law on Animal Husbandry, Law on Veterinary Medicine, Law on Environmental Protection, Law on Biodiversity, Law on Fisheries, etc. “If these laws are not coordinated synchronously, they will lead to overlapping jurisdiction, conflicting standards and inadequacies in organic product certification,” she said.
Delegate Nguyen Thi Suu proposed: Establish a National Coordination Board for organic and biological agriculture, as a focal point for management, ensuring consistency in management and implementation nationwide. Standardize the national organic standards system (TCVN 11041), considering this a mandatory legal basis for certifying the production and trading of organic products. Build a mechanism for monitoring and tracing the origin of products with international recognition, meeting the requirements of deep and comprehensive integration.
“This is the foundation for green, environmentally friendly and bio-safe agriculture - the inevitable development direction of the future,” delegate Nguyen Thi Suu emphasized.
