Need to clearly define Intellectual Property Rights and the scope of AI labeling

On the afternoon of October 15, in Hanoi, the Vietnam Federation of Commerce and Industry (VCCI) coordinated with relevant units to organize a workshop on Comments on the completion of the draft Law on Artificial Intelligence (AI), aiming to build a solid legal basis for the development and application of AI in Vietnam.

At the workshop, Mr. Tran Van Khai, Deputy Chairman of the National Assembly's Committee on Science , Technology and Environment, emphasized that the rapid development of AI poses many legal, ethical and responsibility challenges, requiring a suitable legal corridor that both strictly manages and encourages development.

"Accordingly, management regulations and prohibitions must be truly clear, transparent and balanced in the most reasonable way," said Mr. Tran Van Khai.

Many key contents in the draft approach international standards such as: risk-based management , controlled testing mechanism (sandbox), ethics and human rights in AI, regulations on transparency, accountability and labeling of content generated by AI.

According to Ms. Tran Vu Ha Minh,FPT Software Group, the regulation that suppliers and importers are responsible for self-assessment and self-classification according to criteria risks significantly increasing the compliance burden, especially for units providing many AI systems and models globally because the obligations of AI system developers are unclear, and there are no limits or control mechanisms for importing AI systems into Vietnam, which can easily lead to risks for the domestic market.

Mr. Tran Van Tri, Director of LuatVietnam, proposed that it is necessary to clearly define intellectual property rights between suppliers, developers, and deployers; clearly define the scope and level of application of AI that must be labeled; the pre-inspection mechanism needs to be flexible so as not to slow down the progress of launching AI products; and stipulate citations for easy checking and comparison.

In order for the law to truly come into life and become a driving force for development, Mr. Dau Anh Tuan, Deputy Secretary General, Head of the Legal Department of VCCI, emphasized that it is necessary to ensure flexibility and adaptability in the legal framework, minimize administrative barriers for businesses, especially small businesses and startups, invest heavily and seriously in data and computing infrastructure, and clearly define legal responsibilities, especially in the AI ​​value chain from developers, suppliers to deployers.
