Need to strictly handle the act of spreading leaflets for black credit loans

Fast loans, simple procedures, money available on the same day,... with contact phone numbers are leaflets that some subjects spread in public places, along the roads, posing many risks of "black credit" activities.

After a period of calm, recently in some localities such as Vi Thanh city, Chau Thanh district, ... there has been a reappearance of subjects spreading leaflets "installment loans", "financial support" which are potentially very risky forms of black credit lending.

About 2 weeks ago, some people in Phuoc Long hamlet, Dong Phuoc A commune, Chau Thanh district, discovered that on a rural road in the hamlet, there were many flyers advertising loans and installment loans with phone numbers.

Ms. Tran Thi Them, in Phuoc Long hamlet, Dong Phuoc A commune, said: "A few days ago, in the morning when I opened the door, I saw many pieces of paper in front of my house with the content of lending money, with phone numbers scattered all over. Looking outside, there were also many similar pieces of paper but I don't know who scattered them."

Mr. Le Thanh Cong, residing in Dong Thuan hamlet, Dong Thanh commune, Chau Thanh district, said that "financial support" and "installment loan" leaflets are a form of loan sharking.

"I heard that these lenders are all loan sharks, with very high interest rates. This situation has been reported a lot in the media recently. I think the authorities need to take serious action," Mr. Cong suggested.

Previously, in Vi Thanh city, in April 2023, during a patrol, Ward IV Police, Vi Thanh city discovered two subjects red-handed distributing leaflets in violation of regulations. They were Vu Tien Quyen and Nguyen Nhat Phong, both residing in Phu Ly city, Ha Nam province.

Specifically, the above subjects rode motorbikes and then secretly distributed leaflets on the streets and market areas in Ward IV. Through inspection, Ward IV Police discovered and seized over 2,000 leaflets with the content "installment loans". At the police station, the subjects confessed to temporarily residing in Ninh Kieu District, Can Tho City. The two subjects received leaflets on installment loans from strangers and distributed them in many localities, with the purpose of taking the money for personal expenses.

In fact, in the past, subjects in the "black credit" network often printed advertising leaflets and posted them on electric poles, house walls, trees, etc. The purpose was to publicize phone numbers and some requirements for people to contact for loans, of course with exorbitant interest rates. To prevent "black credit" activities, local authorities and organizations have organized forces to remove advertising leaflets. Along with that, functional agencies organized to monitor, investigate, verify and handle subjects posting advertisements for "black credit" activities in public places.

To deal with the authorities, the subjects of "black credit" activities have changed their advertising methods. Accordingly, instead of posting in public places, "black credit" advertising leaflets are printed on both sides and spread all over the streets. And to avoid being monitored by the authorities, these subjects often operate at night. Obviously, this behavior not only supports illegal credit activities but also causes aesthetic damage.

According to Colonel Nguyen Van Gia, Deputy Director of the Provincial Police, the police agency recommends that people should not believe in the content of these leaflets and advertisements for quick loans and installment loans. Because this is a trap, many people become debtors of black credit lenders. Therefore, in addition to raising vigilance, people should also boldly report to the police when discovering incidents or provide information about the activities of these subjects to facilitate the authorities in fighting and handling.

Decree 28/2017 amends and supplements a number of articles of Decree No. 131/2013, stipulating:

Article 61. Violation of regulations on advertising that affects aesthetics, traffic order, society and means of transport

1. Warning or fine from 200,000 VND to 500,000 VND for the act of distributing advertising leaflets that affect aesthetics, traffic safety and social order.

2. A fine of between VND 2,000,000 and VND 5,000,000 shall be imposed for one of the following acts:

a) Advertising on the front, back and roof of a vehicle;

b) Advertising exceeds the permitted advertising area of ​​each side of a means of transport as prescribed.

3. A fine of between VND 5,000,000 and VND 10,000,000 shall be imposed on those whose products, goods and services are advertised on leaflets that affect aesthetics, traffic safety and social order.

4. Remedial measures: Forced removal or deletion of advertisements for the acts specified in Clause 2 of this Article.
