People's Councils and People's Committees at the commune level are also allowed to issue legal documents - according to the Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents, recently passed by the National Assembly.

The Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents has just been passed by the National Assembly with 432/434 National Assembly deputies present in favor, accounting for 90.38% of the total number of deputies.

Accordingly, People's Councils and People's Committees at all levels are given more authority, especially People's Councils and People's Committees at commune level are also allowed to issue legal documents.

A legal document that is effective in a specific administrative unit will continue to be effective in that administrative unit until it is amended, supplemented, replaced or abolished, unless an administrative unit takes over part of the territory of another administrative unit.

The Law also adds provisions on policy impact assessment, appraisal and examination of the application, promotion of science and technology development, innovation and digital transformation in the process of developing and promulgating legal documents to address the situation of many unsynchronized guiding legal documents, causing difficulties for people and businesses.

The Law has supplemented regulations on the development and promulgation of legal documents according to simplified procedures and processes; transitional regulations on the effectiveness of legal documents when there is a reorganization of the apparatus.

Specifically, if a unit is merged, separated or dissolved, the legal documents of that unit will be applied to the newly formed unit on the general principle that the legal documents that are effective in a certain administrative unit will continue to be effective in that administrative unit until they are amended, supplemented, replaced or abolished. The documents will not continue to be effective if an administrative unit receives part of the territory of another administrative unit.
