Finalizing the number of vice chairmen of People's Councils of provinces and cities after the merger

(Dan Tri) - The National Assembly Standing Committee decided that the number of vice chairmen of People's Councils in provinces and cities merging from 3 units is a maximum of 4 people; provinces and cities merging from 2 units will have no more than 3 vice chairmen of People's Councils.

On the afternoon of October 16, the National Assembly Standing Committee passed a Resolution regulating the number of vice chairmen and vice heads of provincial and communal People's Councils and the arrangement of full-time provincial and communal People's Council delegates.

According to this resolution, the National Assembly Standing Committee decided that the number of vice chairmen of People's Councils in provinces and cities merged from 3 provincial-level administrative units is a maximum of 4 people.

For provinces and cities merging or consolidating from 2 units, there will be no more than 3 vice chairmen of the People's Council.

In localities that do not carry out mergers, the number of vice chairmen of the provincial People's Council shall not exceed 2 people.

Regarding the number of deputy heads of provincial-level People's Councils, the resolution of the National Assembly Standing Committee clearly states that in provinces and cities formed after the merger of 3 provincial-level administrative units, there will be no more than 4 deputy heads. This number in provinces and cities merged from 2 provincial-level administrative units is a maximum of 3 people.

In provinces and cities that do not carry out mergers or consolidations, each Committee of the Provincial People's Council has no more than two deputy heads.

Number of vice chairmen of the People's Council at the commune level, according to this resolution, each commune has 1 vice chairmen of the People's Council. Each Committee of the People's Council at the commune level is calculated on average 2 vice heads.

The resolution recently passed by the National Assembly Standing Committee also clearly states the principles for arranging full-time People's Council delegates at provincial and commune levels.

Accordingly, the Provincial People's Council can arrange for full-time People's Council delegates to work in the following positions: Chairman of the People's Council; Head of the People's Council's committee and Member of the People's Council's committee.

In case the Chairman of the Provincial People's Council is a full-time People's Council delegate, the number of Vice Chairmen of the Provincial People's Council is reduced by one person. If the Head of the Provincial or Commune People's Council is a full-time People's Council delegate, the number of Vice Heads of the Committee is also reduced by one person.

At the commune level, the People's Council at the commune level can arrange for full-time delegates to hold the positions of Chairman of the People's Council and Head of the People's Council's Committee. The Vice Chairman of the People's Council and Vice Head of the People's Council at the provincial and commune levels are full-time People's Council delegates.

In addition, in the transitional provisions, the Resolution clearly states that in localities formed after the merger, if the number of vice chairmen of the People's Council and vice heads of the provincial People's Council at the end of the 2021-2026 term is more than the prescribed number, the number will be kept the same at the beginning of the 2026-2031 term, but there must be a roadmap to gradually reduce it. By the end of 2030, this number must comply with the provisions of the resolution.

Clarifying many issues of concern to delegates before passing the Resolution, Minister of Home Affairs Pham Thi Thanh Tra explained that at the provincial level, when arranging leadership staff, there is accumulated work to meet the requirements of job stability.

But when the district level no longer exists, the formation of a new commune-level administrative unit requires a completely new personnel organization, including leadership, without the accumulation of the provincial level.

The Minister of Home Affairs said that this is also an advantage. In addition, Minister Pham Thi Thanh Tra shared her concerns when calculating leadership positions, especially at the commune level.

According to calculations, at the commune level there are about 40 job positions, corresponding to 40 officials (for isolated communes, without previous mergers). But according to the Minister, in the future it must be calculated based on population size, natural area, economic scale and specific factors...

The Minister of Home Affairs added that statistics at the commune level currently show an average of 30.5 leadership positions. This number is very large. Therefore, the Minister believes that it is necessary to decentralize and delegate authority in conjunction with local responsibilities to calculate appropriately for each administrative unit, otherwise the number of leaders in communes will be a "very worrying" issue in the future.

According to the Minister of Home Affairs, the Ministry is focusing on completing the Project on classifying administrative units and standards of administrative units to prepare a report to competent authorities, then submit it to the National Assembly Standing Committee to issue a resolution on this content.

Regarding the number of deputy heads of the People's Council at the commune level, according to the resolution there are two full-time deputy heads, but the Minister said that in fact there are places where it is not necessary to have two full-time deputy heads, there can be one full-time person and one part-time person to reduce the number.

On the same day, the National Assembly Standing Committee passed a Resolution guiding the determination of the expected structure, composition and allocation of the number of candidates nominated to run for People's Council deputies at all levels for the 2026-2031 term.

According to the recently issued resolution, the proportion of female delegates in the official list of candidates must be at least 35%; strive for an election rate of about 30% at each level (provincial and communal levels).

Delegates who are non-Party members strive to reach a rate of not less than 10% at each level (provincial and communal levels); Young delegates (under 42 years old) strive to reach a rate of not less than 15% at provincial and communal levels.

The re-election of People's Council delegates for the 2021-2026 term is expected to achieve a rate of at least 30%. Along with that, local authorities at all levels, when introducing candidates for People's Council delegates at all levels, must ensure both standards and conditions, and must ensure the selection of delegates who are representative in terms of gender, ethnicity, and youth.
