On the morning of June 5, continuing the 46th session, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of laws in the fields of national defense and security.

Presenting the report, Lieutenant General Thai Dai Ngoc, Deputy Chief of the General Staff of the Vietnam People's Army, said that the draft Law focuses on amending and supplementing a number of articles on the position, role, authority, functions and tasks in the military and defense fields related to the organization of two-level local governments to ensure consistency with the provisions of the Constitution, the Law on Organization of Local Government (amended) and relevant legal provisions. The structure of the draft Law includes 12 articles, including 11 articles amending and supplementing 11 Laws and 1 article on the effective date.
Notably, the draft amends and supplements a number of provisions of the Law on National Defense such as removing the District Military Command; amends and supplements a number of provisions of the Law on Officers of the Vietnam People's Army such as removing a number of positions of Commander, Political Commissar of the Provincial Border Guard Command, Deputy Commander, Deputy Political Commissar of the Provincial Border Guard Command, Commander, Political Commissar of the District Military Command, Deputy Commander, Deputy Political Commissar of the District Military Command.

Some provisions of the Law on Military Service have been amended and supplemented, such as transferring the authority of the district level to the provincial level for the tasks of establishing the Military Service Health Examination Council; deciding on the list of citizens called for military service, performing the obligation to join the People's Public Security, the list of temporary deferment and exemption from military service; recognizing citizens who have completed their military service in peacetime; organizing the handover of troops to units (the handover ceremony is held at the Regional Defense Command).
Transferring the authority from the district level to the commune level for a number of tasks of health examination of non-commissioned officers and reserve soldiers; issuing orders to call up each citizen; registering for military service for the first time, preliminary selection and medical examination for military service, calling for enlistment and performing the obligation to join the People's Public Security...
The draft Law stipulates that the Law on Militia and Self-Defense Forces supplements the authority of the Hanoi Capital Command, the Ho Chi Minh City Command, and the provincial military command in directing and guiding the People's Committees at the commune level, agencies, and organizations to select citizens to perform the obligation to join the militia and self-defense forces.

In the review report, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi agreed on the necessity of promulgating the Law to institutionalize the Party's guiding viewpoint on continuing to organize two-level local governments, ensuring conformity and consistency in the legal system when amending and supplementing the 2013 Constitution and laws related to the organization of the State apparatus.
"I propose that the drafting agency change the name of the Law to the Law amending and supplementing a number of articles of 11 laws in the field of national defense to ensure brevity," said Mr. Le Tan Toi.
Concluding the session, Vice Chairman of the National Assembly Tran Quang Phuong said that the National Assembly Standing Committee agreed to submit the Law to the National Assembly for consideration and approval at the second phase of the ninth session according to the shortened process and procedures.
