The Ministry of Public Security has issued Circular 66/2023/TT-BCA amending and supplementing several articles of Circular 55/2021/TT-BCA dated May 15, 2021, of the Minister of Public Security detailing some articles and measures for implementing the Law on Residence; Circular 56/2021/TT-BCA dated May 15, 2021, of the Minister of Public Security regulating forms in residence registration and management; and Circular 57/2021/TT-BCA dated May 15, 2021, of the Minister of Public Security regulating the residence registration process.

This Circular shall take effect from January 1, 2024.

Regarding residence registration, in addition to the current methods of receiving applications directly at the residence registration agency or online through the public service portal, Circular 66/2023/TT-BCA has added the option of receiving applications via the VNeID application and other online public services as prescribed by law.

Specifically, Circular 66/2023/TT-BCA amends Article 3 on receiving, processing applications and notifying the results of residence procedures of Circular 55/2021/TT-BCA detailing some articles and measures for implementing the Law on Residence.

Accordingly, the acceptance of residence registration applications is carried out either in person at the residence registration agency or online through the public service portal, the VNeID application, or other online public services as prescribed by law.

In cases where applications are submitted directly to the residence registration office, applicants may submit certified copies of documents, copies issued from the original register, or scanned or photographed copies accompanied by the original documents for verification.

In cases where the applicant submits a scanned copy or photocopy along with the original document for verification, the receiving officer is responsible for checking and comparing the scanned copy or photocopy with the original and signing for confirmation; they are not allowed to request a copy of that document.

In the case of online residence registration, the applicant declares information using the provided electronic form, uploads scanned or photographed copies of valid documents (not required to be notarized, certified, digitally signed, or authenticated in any other way) or cites the source of documents from the electronic data management repository of the organization or individual; and pays the fee through the online payment function or by other methods as prescribed by law.

After completing the online application, applicants for residence registration are issued a unique administrative procedure application number to track and check the progress of their application or to receive information to supplement or complete their application when requested by the residence registration authority.

In cases where citizens upload scanned or photographed documents without digital signatures or other authentication, when the residence registration agency conducts an inspection and verification to process residence procedures, citizens are responsible for presenting the uploaded documents for the residence registration agency to check, compare, and record their accuracy in the verification report. The residence registration agency does not require citizens to submit these documents for safekeeping.

Electronic scans or copies of valid, officially issued documents must be clear, complete, and accurate in content; they must have been consular legalized and translated into Vietnamese according to regulations if issued by a competent foreign authority, except in cases where consular legalization is waived.

In cases where information and documents proving eligibility for residence registration have already been shared and accessed from national or specialized databases, the residence registration agency is not permitted to request citizens to submit or present those documents to process their residence registration.

Notifications regarding the outcome of residency application procedures can be made in the form of paper documents, electronic documents, or SMS messages.

The residence registration agency has the right to refuse to process residence registration procedures and will not refund fees if it discovers that the information declared by the citizen is untrue or that the documents provided by the citizen for residence registration procedures have been altered, erased, or forged.

In addition, Circular 66/2023/TT-BCA amends Clause 2, Article 4, stating that information regarding the residence of citizens, households, agencies, and organizations can be received through the following forms: Directly at the residence registration agency; Telephone, hotline announced or posted by the residence registration agency; Suggestion box, email address announced or posted by the residence registration agency; Government electronic portal, Ministry of Public Security electronic portal, websites of police units and localities; Through the VNeID application and mass media.
