The Ministry of Public Security has issued Circular 66/2023/TT-BCA amending and supplementing a number of articles of Circular 55/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security detailing a number of articles and measures to implement the Law on Residence; Circular 56/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security stipulating forms in residence registration and management; Circular 57/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security stipulating the residence registration process.
This Circular takes effect from January 1, 2024.
Regarding residence registration, in addition to the form of receiving documents directly at the residence registration agency or online via the applicable public service portal, Circular 66/2023/TT-BCA has added the form of receiving documents via the VNeID application and other online public services according to the provisions of law.
Specifically, Circular 66/2023/TT-BCA amends Article 3 on receiving, processing records and notifying results of processing residence procedures of Circular No. 55/2021/TT-BCA detailing a number of articles and measures to implement the Law on Residence.
Accordingly, the receipt of residence registration applications is carried out directly at the residence registration agency or online via the public service portal, VNeID application, and other online public services as prescribed by law.
In case of submitting the application directly at the residence registration agency, the person requesting residence registration can submit a certified copy of the original document or a copy of the document issued from the original book (copy) or a scan or photo with the original document for comparison.
In case the person requesting residence registration submits a scan or photocopy with the original document for comparison, the recipient is responsible for checking, comparing the scan or photocopy with the original and signing the confirmation, and is not allowed to request to submit a copy of that document.
In case of online residence registration, the person requesting residence registration declares information according to the provided electronic form, uploads a scan or photocopied copy of valid papers and documents (not required to be notarized, certified, digitally signed or authenticated in other forms) or cites the source of documents from the Electronic Data Management Warehouse of the organization or individual; pays the fee through the online payment function or by other means as prescribed by law.
After completing the application submission, the person requesting online residence registration will be given an administrative procedure file code to monitor and look up the progress of the application or receive information to supplement and complete the application when requested by the residence registration agency.
In case a citizen uploads a scan or photocopied document or paper without a digital signature or other authentication, when the residence registration authority conducts an inspection or verification to resolve residence procedures; the citizen is responsible for presenting the uploaded document or paper for the residence registration authority to inspect, compare and record the accuracy in the verification record. The residence registration authority does not require the citizen to submit such document for storage.
Scanned or electronically photocopied documents from valid, valid documents must be clear, complete, and have integrity in content; have been consularly legalized, and translated into Vietnamese according to regulations if the documents are issued by a competent foreign authority, except in cases exempted from consular legalization.
In case the information on documents proving the conditions for residence registration have been shared and exploited from the national database or specialized database, the residence registration agency shall not request citizens to submit or present such documents to resolve residence registration.
Notification of the results of settlement of residence procedures is made in the form of paper documents or electronic documents, SMS messages.
The residence registration agency has the right to refuse to process residence procedures and not refund fees for cases where fees have been paid if it discovers that the citizen's declared information is not true or that the papers and documents provided by the citizen to carry out residence procedures have been erased, modified, or falsified.
In addition, Circular 66/2023/TT-BCA amends Clause 2, Article 4, information reflecting on the residence of citizens, households, agencies and organizations is received through the following forms: Directly at the residence registration agency; Telephone, hotline announced or posted by the residence registration agency; Suggestion box, email box announced or posted by the residence registration agency; Government electronic information portal, Ministry of Public Security electronic information portal, electronic information pages of Public Security units and localities; Through VNeID application and mass media.
